It is our opinion that you can comply with the language and this issue should not prohibit you from signing the pending lease. However, we feel compelled to advise you of several things that factor into this decision. The Light and Power Department is OK with the plan attached, which is the original sketch we issued. in November of 2005. Although this proposed transformer location is outside of the Light and Power Department's normal requirements, they are willing to work with us because of the very limited space available. They are willing to allow the placement of the dumpsters as shown on this- sketch, provided the dumpsters are all on wheels and can be moved out of the way in case they need to access the transformer. i spoke with the ,Zoning Department this morning to ensure there were no other requirements from their department we have not addressed. Since this is a change of use from retail to restaurant, they will require a new trash enclosure. The trash enclosure can be a wood picket fence, 6' high, and it's sole purpose is to screen the trash area from public view. They will have to approve this plan and proposed new trash enclosure work in order to obtain a permit. I think we can squeeze in the fence, but the gate access may be a bit challenging. I also advised Mr. Barnes that we have no room for recycling, which although not an absolute requirement it is highly encouraged. If we can find some way to add recycling to the area we'll address that as we develop the final plans. We also have to move the gas line to the building in order to place the transformer at it's new location. Currently, the gas line runs directly underneath where the transformer will go and must be relocated. This was not known until locates were done, and this cost is not included with the transformer budget. It is our opinion that at least some of this cost should be shared by Noodles and Company as part of their tenant finish work. You can see from the attached sketch this is tight, but feasible. The dimensions are mostly accurate, but in this case a few inches does make a difference. Our proposed plan will allow for some dimensional variables within a few inches.
