payment of this Lease are provided by the federal government, this
Lease is subject to and contingent upon the continuing availability
of federal funds for the purposes hereof, and if such funds are not
made available, this Lease may be unilaterally terminated at the
end of any month provided a ninety (90) day advance notice of
termination is given to the City in writing.
40. Contingencies. This Agreement is made expressly
contingent upon the approval of this Agreement by the City Council
of the City of Fort Collins (hereinafter "the Council"). In the
event the Council fails to approve this Lease on or before February
15, 1994, this Lease shall be automatically terminated and all
parties shall be released from all obligations hereunder.
If the Council does pass such an ordinance on or before
February 15, 1994, but within ten (10) days of the passage of the
ordinance a notice of protest against the ordinance has been filed
with the City Clerk of the City of Fort Collins pursuant to Section
2(b) of Article X of the Charter of the City of Fort Collins and
pursuant to Section 2(c) of Article X of the City Charter, the City
Clerk presents to the Council a petition certified by the Clerk as
sufficient for referendum, this Lease shall remain in full force
and effect unless and until: (1) the electors vote to. repeal the
ordinance; or (2) the Council repeals the ordinance in accordance
with Section 2(c) of Article X of the Charter of the City of Fort
Collins. In the event the ordinance is so repealed by the electors
or by the Council, then this Lease shall be automatically
terminated and all parties shall be released from all obligations
hereunder.
If the Council does not repeal the ordinance and if the
electors approve the ordinance, then this Lease shall take effect
ten (10) days after the date of the electors' approval of the
ordinance.
IN WITNESS WHEREOF, the parties hereto have entered into this
Property Lease Agreement the day and year first above written.
