construction and may be incorporated into the
bridge and to North College Avenue. CSU agrees
that it shall not object to the widening of North
College Avenue or of the Cache La Poudre River
bridge. CSU shall have no responsibility for any
of the construction costs related to the aforesaid
project, including costs associated with curb,
gutter or sidewalk improvements or expenditures of
money that may be necessary to repair landscaping
or sprinkler systems upon the Property. It is
understood that the City cannot guarantee access to
the Property at all times during the State's
construction project.
(c) The City shall be responsible for the installation
of a fence between the hiking/bike trail as
described in this section and the former
transformer yard located on the north side of the
Power Plant building.
21. Accesses. If requested by the City, CSU shall provide
public access to the hiking/bike trail as described in Section 19
above across the Property leased to CSU and the City shall be
responsible for maintenance of those areas required to provide such
public access. CSU hereby agrees to provide access for the Fort
Collins Police Department to the police call box located in the
parking lot on the east side of the Power Plant building. CSU
shall exert a diligent effort to limit access within the building
to the "utility tunnel" connected to the basement of the Power
Plant building such that only persons specifically authorized by
the City may enter said tunnel. CSU agrees to provide City and
Poudre Fire Authority authorized personnel access to the parking
lot and the "pumper test pit" located therein until the Poudre Fire
Authority has completed the construction of its new fire testing
and training center on West Vine Drive or until December 31, 1994,
whichever occurs last.
22. Historical Preservation/ Funding. CSU agrees to exert a
diligent effort to obtain grants or other funding for the
historical preservation of the Power Plant building facade and the
"Fountain" located on the grounds to the west of the Power Plant
building. The City shall cooperate with CSU in the effort to
obtain grants or funding. Promptly upon execution of this Lease,
CSU shall attempt to obtain such funding and if such funding is
obtained, CSU shall submit a plan to the City describing the
actions that CSU intends to take toward the preservation of such
building facade and Fountain.
23. Default. If CSU shall neglect or fail to timely and
properly perform any covenant, condition or provision of this
Lease, whether such neglect or failure is caused by insufficient
