Use of the Property shall be amended by adding a new subparagraph (c) to read as follows: (c) The City reserves the right to create additional designated parking areas on the Property, and to use any of the parking areas of the Property for City and public parking purposes outside of normal business hours. The City will place appropriate signage reserving not less than seven (7) parking spaces adjacent to the west side of the building for CSU staff and CSU visitor parking only at all times. Notwithstanding any other provision of this Lease, CSU shall not be responsible for injuries to persons or property arising from the use of the Property by the City and/or the public for events and purposes sponsored or permitted by the City. D. Paragraph 33. Indemnity shall be amended to read as follows: 33. Indemnity. CSU shall defend and hold harmless the City against claims arising from the alleged negligent acts or omissions of CSU, its agents, contractors and public employees, which occurred or are alleged to have occurred during the performance of their duties and within the scope of their employment, unless such acts or omissions are, or are alleged to be, willful and wanton. The city shall have no liability or obligation in connection with any damage, injury or other loss resulting therefrom. Any claims against the City or CSU shall be subject to the limitations of the Colorado Governmental Immunity Act, CRS 24- 10-101 to 24-10-120, as now or hereafter amended. EXCEPT AS SET FORTH HEREIN, the terms of the Lease Agreement shall remain in full force and effect. Page 2 of 3
