Dear Ms. Cherry
The City of Fort Collins is responsible for enforcement of zoning ordinances and similar codes or
ordinances related to development in the city of Fort Collins.
The above -referenced property is located in the HC (Harmony Corridor) zoning district. The
permitted uses in this zone include any use that was authorized pursuant to an approved site
specific development plan that was processed and approved prior to March 28, 1997 ( Section
4.26(B)(1)(b) of the Fort Collins Land Use Code). The property in question was developed in
accordance with the Fort Collins Retail Center PUD for Pad B site specific development plan that
was approved by the City of Fort Collins on December 16, 1991. Therefore, the current use of the
property as an Applebee's Restaurant is a legal and approved use that is in compliance with the
zoning code. The abutting properties to the north, south, and east are also located in the HC zone.
The property to the west is located in the C (Commercial) zone.
To the best of our knowledge, the property complies with the requirements of the approved site
specific development plan in all respects including, without limitation, use, density, parking,
setbacks, height, floor/area ratio, landscaping, etc. These requirements are set forth on the
approved Planned Unit Development plans, which can be obtained from the City's Technical
Services Department at 281 North College Avenue, 970-221-6588. There are no nonconforming
issues relevant to this property, and there are currently no known Zoning Code violations for the
development. Additionally, the property is not in any special or restrictive districts, but is located
within the Transit Oriented Development overlay area. No variances, special exceptions, conditional
use permits, or zoning relief were granted to this property.
