This letter is intended as a follow-up to our phone conversation of earlier today regarding the use of
the property at 328 Remington Street in Fort Collins.
Staff members from the Fort Collins Building & Zoning Department have had several conversations
with Michael Gaines regarding the use of the above -mentioned property. As you know, 328
Remington is located in the NCB (neighborhood conservation buffer) zoning district.
Vocational schools are one of the permitted uses in the district. I had informed Mr. Gaines that a
performing arts school would be considered a vocational school, subject to the appropriate review
process. To date, the required review process to approve the school use has not been initiated by
Mr. Gaines. Therefore, even though the use is permitted, it has not been made legal. We had also
discussed the possibility of the building being used as a "place of assembly" in order to allow public
performances. However, a "place of assembly" does not include buildings used for commercial
endeavors like motion pictures or stage productions. I explained to Mr. Gaines that once the school
use is authorized then occasional 'benefit' performances put on by his students would be permitted
so long as they are a non-profit type of performance. This would be a similar situation to a public
school presenting a student performance to friends and family of the students. Mr. Gaines also
mentioned possible future uses of the property, to which he was informed that rezoning of the
property would be necessary in order to allow such uses. To summarize, no zoning variances or
zoning approvals have been granted to Mr. Gaines at this time for any of the non-residential uses
that have been occuring.
In addtion to the zoning issues, Building Inspection Supervisor Mike Gebo and Tom Demint of the
Poudre Fire Authority have had discussions with Mr. Gaines regarding building and fire code issues
associated with the assembly use. Those code issues would have to be addressed before Mike and
Tom can approve the assembly use. At this time, those code issues have not been addressed, and
the assembly use is not allowed.
