SUBJECT: Allegation bf a Zoning Violation in 900 block West Prospect
I have visited th1. e property east of the Plymouth Congregational
Church (probably 912 W. Prospect) occupied by Eugene k1iller 482-8233.
I have discussed the unsightly mess in the yard caused by repairing
vehicles and leaving other vehicles parked in their front yard. Both
sons deny that any business is being conducted on the premises. They
maintain that the vehicles repaired there belong to them. They further
allege that they are in the process .of cleaning up the yard. I was not
able to observe anything that led me to believe that these are other
than the true facts in the matter. It might be possible to prosecute
under definition of a junkyard in the Zoning ordinance but it'd be an
extremely weak case. I recommend that we see if we can obtain voluntary
cooperation from the occupants. The City Attorney has advised me, in
prior cases of. this kind, that he prefers to exhaust all administrative
remedies before resorting to prosecution in the municipal court. I'll
continue to work with the Millers to try to ameliorate the objectionable
appearance._ I cannot find that there is prima facie evidence of a
zoning violation at present.
