Irwin 4855 Ricara Drive Boulder, Colorado Dear Sir and Madam: Telephone 303 484-4220 June 25, 1969 The premises which you own a 630 North City of Fort Collins being lot 9, block 326 of the Capitol Hil s ddition to the City, are not being properly maintained and secured to prevent unauthorized entry. On or about the third of June I visited the premises and found all doors open, window glass broken out, personal property strewn about and electrical wir- ing exposed. I presume this destruction has been caused by vandals, but in any event the conditions are such that the buildings constitute a fire hazard. The open structures are an invitation to transients and as such constitute a furthur hazard to public welfare and safety. On May 1, 1969, Mr. Jerry Harrison, acting Chief of the Fire Prevention Bureau wrote notify- ing you of the fire hazard. Section 203 of the Uniform Building Code, 1958 Edition defines unsafe buildings as those --- "which constitute a fire hazard or are otherwise dangerous to human life, or which in relation to existing use constitute a hazard to safety or health or public welfare by reason of inadequate maintenance, dilapidation, obsolescence or abandonment --- ". Unsafe buildings are a public nuisance and must be abated by repair, rehabilitation, demolition or removal. In this case I do not believe you would want to at- tempt rehabilitation of the former store and gasoline station unless it were to convert it to another use. The entitlement to non -conforming use as a business property has expired but the premises may be used for medium density residential uses as defined in the City Zoning Ordinance. Will you please advise me within ten days of receipt of this letter of your plans for abating the nuisance. Very t ly yours, Gordon F.
