Waldo, Chief Building Official Lynn Greenwood, Chief Plans Examiner Present for Appeal #%271 Don Hisam, Fire Marshal APPEAL NO. 269 — Application made by John Clarke on behalf of self for a variation from the requirements of Section 1711 and Table 33—A of the Uniform Building Code (1976 Edition) so as to eliminate the re— quirement for a ramp and grab bars for the physically handicapped. Address — 706 E. Stuart Single family dwelling with Home Occupation for photography 1824 sq.ft. assigned to home occupation, part of this area used for dark room, etc. Building under construction. Mr. Donald Sampson presented the plans. After reviewing the plans the Board stated there were no problems with the ramp as presented and they felt there would be no hardship,perhaps other than the looks of grab bars,to go ahead and comply with the code. They felt perhaps fancier than usual grab bars could be used. The Board stated that they would certainly hesitate to grant a variance from the oodeifor the handicapped on a new building. They have only granted variances previously on existing building. MOTION MADE by Harold Miller that the appeal be denied due to the size of the facility and due to the fact that it was new construction. SECONDED by Richard Hollar. MOTION CARRIED UNANIMOUSLY. APPEAL NO. 270-- Application made by Phillip G. White on behalf of self for a variation from the requirements of Sections 504(b), 1711, and Tables 5—A and 33—A of the Uniform Building Code so as to permit the elimination of the ramp and toilet room access and facilities as required for the physically handicapped and unprotected wall and openings 5.7 feet from property line. continued PAGE TWO BBA - 6/5/79 Address - 417 South Sherwood Present occupancy - single-family Proposed use - B-2 office (real estate) 2-story wood frame structure with basement - basement to be used for service of building only. Square footage of 1st and 2nd floor combined is approximately 2,400 square feet. The height of the first floor Level from grade makes it rather difficult to provide a ramp. The wall in question is located 5.7 feet from property line at one location. The reaminder of the wall is located 7.5 feet from property line. The distance from the portion of the wall that is 5.7 feet from property line and the adjacent building to the north is 181. Mr. White presented sketches and pictures. There will be 2,single person offices. with secretaries, probably six (6) people in and out of the building all together. Mr. Hisam stated he had no problem, especially since eliminating sleeping quarters would possibly make it a less hazardous occupancy. MOTION MADE by Richard Hollar to grant the variance on the property distance of unprotected wall and openings 5.7 feet from property line based on the fact there is an established residence next door and the fact that there is less fire hazard with a B-2 occupancy than with a single family dwelling use. Motion made to grant variance also based on the fire marshal's statement of approval. SECONDED by Chet Smith. MOTION CARRIED UNANIMOUSLY. The Board then considered the application for deletion of require- ments for the handicapped. Mr. White stated the proposed businesses do not ordinarily have regular walk in clients and if they do have a handicapped individual, they can easily go to that persons home. MOTION Made .by Chuck Onstad to grant the variance from the requirements for the handicapped I due to the nature of the businesses and the fact it is an existing building. SECONDED by Harold Miller. MOTION CARRIED UNANIMOUSLY.
