City of Fort Collins Utilities CERTIFICATION of NO-RISE This is to certify that I am a duly qualified registered Professional Engineer licensed to practice in the State of Colorado. It is further to certify that the attached technical data supports the fact that the proposed or as-built (name of development) activities in the floodway do not create an adverse rise or drop in base flood elevation (BFE), change in watercourse location, add new area within the floodway, or result in any physical change to the hydrology or hydraulic conveyance within the floodway in accordance with Code §10-45(2), or a change to floodway boundaries on (stream name) at published or unpublished cross-sections in the FEMA Flood Insurance Study or the City of Fort Collins Flood Study dated (study date) in the vicinity of the proposed development. I acknowledge that all attached documents were prepared by me or under my review, and all are true and accurate to the best of my knowledge. Denver, CO 80216 Prepared by: TAIT & Associates, Inc. 6163 East County Road 16 Loveland, Colorado 80537 Phone: (970) 613-1447 Fax: (970) 613-1897 Pre-Construction Certification: June 22, 2023 Revised: July 19, 2023 Revised for Post-Construction Certification: December 6, 2023 2 Purpose This letter serves as documentation to show that the proposed improvements within the high risk floodway and floodplain for the Events Center Remodel have been evaluated and determined that there will be no rise on the current effective base flood elevation (BFE) and does not result in changes to the floodway and/or floodplain boundaries (City of Fort Collins flood map Canal Importation Basin CSU-Shields Underpass LOMR dated February 24, 2020). All constructed improvements are in compliance with the current City of Fort Collins floodplain regulations and municipal code. Background and Introduction The extent of work within the floodway includes replacement of an existing sanitary sewer service line, replacement of exiting landscaping with concrete paving, and replacement of existing concrete sidewalk in kind. The existing sanitary service line was replaced using an open trench approximately 105 feet by 4 feet wide and 4 feet deep. The extent of work within the floodplain includes replacement of existing concrete sidewalk in kind. All concrete and asphalt were replaced to match existing grades. The relevant Special Hazard Flood Area(s) are the Canal Importation Floodway and Canal Importation Floodplain along West Elizabeth Street. This site drains to the Old Town Basin per the Current Fort Collins Master Drainage Plan. Applicable Floodplain Ordinances and Compliance Floodplain Ordinances Compliance § 10-16 – Definitions. Excavation, paving, and change in use are considered development. A Floodplain development permit has been issued for the work performed. § 10-27 - Floodplain use permit - A floodplain use permit shall be obtained from the Utilities Executive Director before any construction or development begins within any flood hazard area established pursuant to this Article. A Floodplain development permit has been issued for the work performed. § 10-45 – Floodway Evaluations. The development, obstruction or activity must be shown by appropriate floodplain modeling to result in no increase in base flood elevations. A Certificate pre-construction and post- construction signed by a professional engineer must be provided. This letter along with associated survey and photos provide certification that this development did not result in a rise in the floodway. § 10-47. - Changes of use. No person shall cause, nor permit on property under said person's ownership or control, the construction or installation of improvements on the property, or a new use of the property or any portion thereof, if the same shall result in a use or expansion of a use of the property inconsistent with the requirements and prohibitions of this Article. This project and improvements did not have any negative impacts on the floodplain and did not result in any use that is inconsistent with Article II of Chapter 10 of the Fort Collins Municipal Code. 3 § 10-105 (3,4,5,6,7)- Construction of new hard surface paths, trails and walkways, placement of fill, outdoor storage associated with nonresidential use, whether temporary or permanent, construction of new driveways and parking areas, and placement of new vegetation in the floodway in a location or of a quantity or type that is determined by the Utilities Executive Director to likely result upon maturity in an increase in base flood elevations is prohibited, unless all applicable requirements, including, but not limited to, the requirements of § 10-45, are met. Outdoor parking that meets the definition of outdoor storage in § 10-16 shall be subject to regulation as outdoor storage. All applicable requirements from section 10-45 were met as part of this remodel project. No areas within the Special Flood Hazard Area will be used for storage during or after construction. Post Construction Recertification Post-construction photos and as-built survey have been provided. An analysis of the final and original conditions was performed, and the constructed grades match existing grades to 0.0 feet when rounded. There is one location indicated in Figure 1 that varies from the pre-construction survey due to rounding. The full decimal in the pre-construction survey reads 5029.240’ and in the post-construction survey reads 5029.283.’ The difference from pre-construction to post- construction is within the 0.049’ tolerance for City Floodways per chapter 10 of the Municipal Code. This is certificate signed and stamped by a professional engineer to ensure the improvements were constructed within general compliance of the plans, there has been no rise in BFE, no adjustments to the floodway or floodplain boundaries, and all requirements of chapter 10 of the Fort Collins Municipal Code have been met. Conclusion Based on the information presented in this letter and the attachments provided, the exterior work performed as part of the remodel at 1221 West Elizabeth Street has no impact on the BFE and relevant SFHA’s.
