A detention pond located along the east portion of the lot provides 100 year detention and water quality for the lot. The detention pond has an orifice plate that regulates the 100 year release from the pond. A field inspection was done May 9, 2007 and verified that the outlet structure with the appropriate orifices are in place and have been constructed within substantial compliance to the approved plans. Based on as built topography by Engineering Survey Company, Charles Beckstrom, PLS 33202, the following detention pond volumes were calculated. DETENTION POND • Design 100 year water surface: 88.33 • As built 100 year water surface: 88.00 • _Design 100 year detention volume: 1,038 cubic feet • As built 100 year detention volume: 1,340 cubic feet As built detention pond calculations are attached. Engineering_ 6-13-2007 Jay Barber City of Fort Collins - Stormwater Engineering 700 Wood St. Fort Collins, CO 80522 Re: Requested detention pond improvements - Safeway Fuel at Taft Hill and Valley Forge Dear Jay, We have informed Safeway of the City's request to have them remove and replace the concrete pan and flared end section in the detention pond of the Safeway Fuel facility that is located at the Southwest corner of Taft Hill Road and Valley Forge Ave. Safeway does not feel that these improvements are warranted for the following reasons; 1. The improvements were never mentioned during the planning, permitting, or construction phases, including the city inspection to release the Certificate of Occupancy. 2. The contractor is no longer at the site thus the cost of improvements will cost more now than if we would have been notified earlier during the construction phase. 3. Safeway is trying to build the business of the fuel facility. Bringing construction personnel, equipment, etc. back on -site so soon after the grand opening will likely have negative business impacts. 4. As discussed, the inverts in and out of the pond were set before Safeway Fuel was built. Repouring the concrete trickle pan will not prevent water from ponding as this area is relatively flat. The requested improvements are not necessary for the proper operation of the pond. Safeway had to put up a $1,000 surety for erosion control measures. Since the construction according to plans is finished and the site has its Certificate of Occupancy they would like to formally request the release of this $1,000 surety. A. Black; Jay Barber Jeremy, Jay is out for a little while longer but I did get your letter today about not wanting to fix the drainage pans. We can do some research to see when we first told the contractor about needing to repair the pans but it was well before the CO. Jay talked with Jeff with Stanford Corp. about half way through the project and later Ruben after Jeff was off the job. He also had a conversation with Dave Meyers from the Corporate headquarters. Jay also talked with Chip Beckstorm with Engineering Service on 5-18-07 about his. We can get documentation if you want to argue the point. It doesn't really matter anyway. You as the engineer should have had something on the plans about it. It is not the City's job to design to catch everything on the site that needs done. That is the design engineers responsibility. Since the pans were buried due to lack of maintenance by the owners it is your responsibility to have followed up once they were exposed. We collected a $1000 escrow for the pans and flared end section that were not done in order to allow release of a CO. So now to say we didn't mention it before the CO is an obvious and well documented lie. Your second point I don't believe is valid either since your contractor was still onsite. We shouldn't have to catch these things. There should be open conversations about them and it sounds like there were even though now you claim there weren't. We are not onsite every day like the contractor. We get involved at CO unless we are contacted earlier by you or the contractor about site issues like this. Your third point is brought on by the lack of not addressing this earlier. It could have been addressed while the contractor was still there. Besides the flared end section is on the plans and has not been installed. Your fourth comment about it not being necessary may be your opinion but not ours. I talked with our erosion control inspector, D.A. Black, and he cannot release the $1000 erosion control escrow until the site work is complete. Therefore until this issue of the pans is resolved and the sod replaced he cannot release that $1000 either. Please feel free to contact me about this. I would like to meet with you and your client should you not agree to install the flared end section and repair the pans. A site meeting might be in order for your client to see what we are talking about. Jay will be back on July 9 and I would like him at any meeting we have.
