I hereby state that the elevations and drainage pattern shown on the enclosed Final Grade
Survey Plan were developed from a survey performed on the referenced property on November
22, 2003, by Absolute Surveying, Inc. To the best of my knowledge, the surveyed grading is in
compliance with the approved grading plan for this lot and subdivision as shown on the
approved utility plans. The relative elevations as depicted may change subsequent to the date
of the survey, due to the subsidence or up eaval of soil, addition or removal of soils by acts of
man, erosion by wind or water or other fa2l ore, this survey may not accurately depict
the elevations and drainage pattern of _ erty after the date of the survey.

The elevations and drainage pattern shown on the attached Plan are the Professional
Engineer's findings of the finished ground around your residence on the date shown above.
You, the homeowner must maintain these elevations and grades to properly drain the water
away from your house. The builder of your home will not cover damage to your home caused
as a result of changes made in the finished grades.

Dear Joe
I must admit that when I first met you, I had a favorable impression. I
enjoyed our first brief conversations and the way you responded to the
initial
problem created when your subcontractor dug the house foundation at 2719
Featherstar Way. What shocked and disappointed me last week was your
response to my
letter complaining again of yet another problem created by the same
contractor.
Yes, you did tell me again that things would be made right. But then you
shocked me when you told me I would have to share the cost of some work
concerning
your lot drainage issue. To expect someone to pay for something that is
not my
problem is taking a real liberty. Well, I must admit I was aggravated
but
decided to refrain from saying anything until I had my ducks in order.
Since we spoke, I talked to Gary Lopez in the Fort Collins Planning
Department and Glen
Schunder In the Storm Water Department. They both had the same reaction
to your
suggestion that I share the cost, and that reaction was "no way." Glen
then
referred me to Jay Barber, who did a site visit on October 20, 2003, at
11a.m. He told
me I did not have a drainage problem. He stated that he often sees
issues like
this when people build close to the property line. He clearly stated it
was
the responsibility of the builder to deal with the problem and bear the
cost.
At this point, I want to make it perfectly clear that nothing is to be
done on

my property until I have reviewed a hard -copy plan of possible options
as to
what can be done and have signed off on a mutually agreed -upon option. I
know that you are busy but have not gotten back to me yet. I will be on
vacation
until the second week in November and will deal with this issue at that
time.
I did inform you at the point of our last conversation of my time
constraints.
I am enclosing a copy of the letter that I informally sent you as a
matter of
record. Again I am truly disappointed.
