Final-Drainage.Certification
Dear Basil,
This letter is intended to provide further certification of drainage facilities located at the
Harmony Safeway Marketplace. In my initial certification letter of December 9, 1997, I listed
the following items that needed to be completed:
Per the approved plans, these items still need to be completed
^^\ Trickle pans in the open channels along Harmony Road
Storm sewer pipe under McMurray
Orifice plate at the outlet structure - Pond N.
These items have now all been completed
I have attached a copy of the McMurray Storm sewer, with the design and As -Built elevations
shown. The As -Built elevations have been provided to our office by Landstar Surveying.
Please let me know if you have additional questions regarding this project.

Drainage Certification
Dear Basil,
The following letter is in regard to the Harmony Safeway Marketplace project, located at the
northwest corner of Harmony Road and McMurray Avenue. This is a partial certification of the
drainage facilities installed to date per the approved drainage and erosion control plan for the
project. It is our intent to finalize this certification once the remaining items have been completed..
Per the approved plans these items have been completed:
All of the onsite storm sewer pipe
Detention Pond N, including the Overflow weir
Open channels along Harmony Road
Storm sewer pipe under Innovation Drive
Storm Sewer pipe under the main site entry off of Harmony Road
Curb Inlets along Monte Carlo
Trickle pans in Detention Pond N (These pans were installed in lieu of Riprap pads at the
pipe outlets, per verbal approval by Basil)
Per the approved plans, these items still need to be completed
Trickle pans in the open channels along Harmony Road
Storm sewer pipe under McMurray
Orifice plate at the outlet structure - Pond N.
In an effort to obtain a TCO for the Safeway Store, the owners are escrowing to the City of Fort
Collins for all of the improvements that remain to be completed. Their list includes the storm
drainage system improvement items listed above, as well as several other items unrelated to the
storm improvements.

Attached is a copy of the As -Built elevations and contours for Pond N. It was found that the
invert out of Pond N is at approximate elevation 69.1. The overflow weir will overtop at an
elevation of approximately 73.83. The required volume for Pond N was calculated to be
approximately 104, 200 cubic feet. This would be provided at an elevation of approximately
73.77, below the spill elevation of 73.83.
There were several downstream improvements that will be accomplished by others, or by the
developers of the pad sites along Harmony Road. We designed this project such that all runoff
from developed areas is routed through he northeasterly pond (pond N). There is a note on Sheet
C2 of the approved Utility plans which states that as Subbasins S-3 and S-5 develop, outfall
capacity must be verified. Here is a status report on what has been done:
The storm sewer pipe has been installed under Innovation Drive
The channel around the Light and Power substation has been reshaped along the easterly
fence line.
Pipes have been cleaned at the crossing of the Irrigation Ditch
Channel has been regraded North of the Ditch.
No capacity checks or elevations have been included as a part of this certification.
As you know, this site has several future building pads that were not developed with Safeway.
Attached also is a "Long Term" Erosion Control plan to be implemented by the owner. These
interim measures are intended to control site erosion until a permanent vegetative cover can be
installed as weather allows. I have also attached a copy of the long term erosion control plan for
disturbed areas. Implementation of this long term erosion control plan will begin as soon as
weather permits.
As mentioned above, it is our intent to provide the City with a certification of the items remaining
to be completed.
A request was made by the Stormwater Utility for the developer of this project to verify the
elevation that the Regional Pond for Golden Meadows will overtop its banks, and to verify the
Minimum opening elevations for adjacent residences. Safeway has agreed to do this work in an
effort to cooperate, and will provide the City with these elevations as soon as Landstar has taken
them, probably within the next two weeks.

drawings up to the aggregate amount of USD1.67,085.50 (One Hundred Sixty Seven Thousand Eighty Five
and 50/100 United States Dollars) effective immediately at our office at 580 California Street, Suite 2100,
San Francisco, California, 94104.
We hereby undertake to honor your sight draft(s) drawn on us bearing upon its face the clause
"Drawn under The Bank of Nova Scotia Letter of Credit Number S010/81695/98 dated December 15, 1997"
accompanied by the following documents:
1) This Credit
2) A signed statement on the City of Fort Collins, Colorado letterhead signed by an authorized
official stating that Safeway Inc. has failed to complete the various improvements as set
forth in connection with Safeway Inc. proposed New Store Project number 1552 situated
at 1426 E. Harmony Road, Fort Collins, Colorado.
We hereby agree with you that drafts drawn under and in compliance with the terms of this Credit
will be duly honored by us if presented at this office or by registered mail on or before the expiration date of
December 15, 1998.
Draft presentation before no later than 9:00 a.m. Pacific Standard Time on any business day shall
be honored before 5:00 p.m. Pacific Standard Time on the same business day by wire transfer in immediately .
available funds to any account designated by you (or any other reasonable means specified by you). Draft
presentation after 9:00 a.m. Pacific Standard Time and before 5:00 p.m�\Pacific Standard Time, on any business
day shall be honored on the following business day in immediately available funds to any account designated by
you (or any other reasonable means specified by you). As used in this Credit, the term "business day" means
