Box 580 Fort Collins, CO 80522 Dear Glen, STORMWATER RECEIVED OCT 0 8 1996 This is regarding Evergreen-Park=Second=Filing,_Phase_I-Development. On behalf of the contractor, Classic Custom Builders, Inc., I am requesting the release of escrow money that was required May 7, 1993. Jean Pakech has researched this matter and determined the escrow has not been released. The enclosed copy of the letter dated May 3, 1993 which listed the items needing escrowed was agreed to by Classic Custom Builders and by you. The following is an explanation of each item and they are shown on the enclosed copy of the Phase One Grading Plan. Item one is a two foot wide concrete pan required along the rear property line between Lots 14 thru 22 and Lots 23 thru 31, Block 4, and between Lots 12 and 13 facing Foxtail Street and Lot 13 facing Sugarpine Street. The length of pan was to be 795 lineal feet and the estimated cost was $4,925 and the escrow amount was $7,387.50. 345 lineal feet of pan was constructed and certified on the enclosed certification plan dated December 14, 1994. The grading plan for Lots 27 thru 30, Block 4 was revised to have the storm water from Lots 15 thru 19 drain along the side lot lines of Lots 27 thru 30 to Brewer Drive. The revised drainage plan was also certified on the enclosed plat dated December 14, 1994. Lots 14 and 31, Block 4 were graded to drain to the rear yard swale between Lots 1 thru 12 and Lots 31 thru. 39, Block 4. That swale was certified August 6, 1996 and Lot 31 was also certified August 6 1996. Therefore the $7,387.50 should be released at this time. Item two is for a percolation/infiltration drain that was required along the rear of Lots 10 and 11, Block 1. The "French Drain". was required along with a retaining wall because these two lots had been built on and graded by a previous contractor and their rear yards were lower than the pan to be constructed on Lots 7 and 8, Block 1. The estimated cost was $1,562.50 and the escrow amount was $2,343.75. The "French Drain" and the retaining wall and the drain pan were constructed in 1993. The rear yards of Lots 10 and 11, Block 1 do not have any evidence of ponding and the lawn is in good shape. Therefore the $2,343.75 should be released at this time. James H. Stewart and Associates,. The grading was done and the existing lawn is in good shape. There was no escrow for this grading. All of the drainage facilities that were guaranteed through escrow money are existing and look to have been maintained properly. They have been existing for approximately three years and there are no apparent drainage problems. Thank you for your assistance in this matter by releasing the escrow as soon as possible.
