I Michael Brake,a Colorado registered professional engineer,verify that the above reference property in
the City of Fort Collins,Colorado,has been inspected by me or an appropriately qualified professional
under my direct supervision,and verify that construction of all grading is complete,and that the
elevations and drainage patterns shown on the attached drawing(s)which were developed from a survey
performed on July 12,2012,accurately and truly depict the elevations and drainage patterns as they
existed on the date of the survey. Base on this information,I certify that:
■ The new grading and any related improvements will not diminish the capacity of the
swale or alter the grade of the Swale;

Larry,
I haven't seen the drawing you mentioned that would show the detail of what is being proposed. I got a
call from Mark Foster saying he would have someone in the area that could make the change in the next
few days but I have not heard anything since then. What Mark described in his message sounds like it
might work for 627 Sparrow PI as an access to the side door. I did leave him a message that I would be
expecting to see the drawing and certification from your engineer.
I was at the site this morning and have a similar suggestion. Maybe leave the pad as is and pour a
retaining wall around it with one step down to the back side. That way the soil supporting the pad can't
wash away and it would lessen the drop for access to the rear of the lot. Just a suggestion.
The biggest issue I noticed is that most of lots 17-20 and the backs of lots 21-24 all drain to the side lot
swale along the side of 627 Sparrow PI (lot 25). Our design criteria only allows a maximum of three lots
to drain to a swale between buildings. Usually it is the uphill two lots with a common lot line and then half
of the lots adjacent to the swale. The existing grading does not comply with the approved grading plan. I
have attached a portion of the grading plan. There is to be a similar swale between the buildings up hill
from lot 25 which are lots 21-24. They also have a 6 foot drainage easement either side of the property
lines for this drainage. Since these lots are mostly still under construction this can still be corrected.
However if there are doors that access into the easements there will have to be encroachment permits for
all of them and your engineer will need to certify the capacity of the swales. His certification for 627
Sparrow is not correct and if he had visited the site as is required he should have noticed it.

Larry,
This issue has been dragging on now for over two weeks and we have yet to get a reply from you or your
engineer about what you plan to do to correct the erosion issue in the swale/easement on the side of the home at
627 Sparrow PI. The stability and capacity of the swale are the primary concerns that need to be addressed
before we can consider issuing an encroachment permit or some sort of license to allow the exit pad from the
door on the side of the home at 627 Sparrow PI. to remain in the easement.
Jay Barber released the SW Eng hold on the CO so that the closing would not be delayed in good faith that you or
your company would address the issue. This is Friday so I'm not expecting an immediate reply today but I wanted
you to know that we are serious about this issue and expect a response next week.
What I am expecting from you is certification from your engineer that the swale capacity and grades will allow the
100 year runoff as designed to pass through the swale and that the swale and access pad are stable and will not
erode out from the flows. That can be addressed in a number of ways that Jay has discussed with you.

The issue is an access pad in the drainage easement that drains lots upstream of this property. Not only is it an
encroachment but there is an existing erosion issue. I have contacted one of the City Attorneys and she is going
to decide if it should be an standard encroachment permit filed with the County or some other document.
