I appreciate you sending over the ILC, Mike. That’s helpful to see the patio location in relation to the
property line. I don’t think it’s necessary to remove the end of the patio at this time. I think it will be
a little goofy with the patio extending below the fence – or at least my understanding is the fence
will be moved to the property line along the Tract/Lot, which may be a little funny. If it turns out the
City needs to remove part of the patio in the future to work on this storm sewer, we’d look for the
patio to end at the property line rather than extend over as it currently does.
Please keep me posted as the fences are adjusted; so, I can check and sign off on the permits
accordingly.

I hope this message finds you well also, and thank you for getting back to me. I appreciate your
willingness to remove/relocate the fence. Yes, please do remove the boundary fence crossing Tract
A also.
I don’t have a concern with the turf, but other landscaping becomes a challenge to address.
I’m not sure when you purchased the property, but the issue really started in 2020 when the
foundation excavation exposed the pipe and the excavator did not properly replace and compact the
pipe bedding and backfill. It’s hard to know if or when this will become an issue; hopefully, it will
not. Regardless, if the tract is cleared, the City is willing to keep the O&M on the pipe since there
will be less obstacles to contend with in an open tract versus what was essentially back yards.
Speaking of back yards, can you tell me how far is the “very slight” overlap with the patios extending
into tract? Are we talking about inches, feet, or yards, and can you show me on a plan drawings
approximately where those patios are in relation to the pipe? If you’re having the stormwater
certification for the site completed, It would be helpful to see that including the surveyed patio
locations as they relate to the pipe since I believe the pipe was not installed in the center of the
tract.

I’ve been forwarded the below from Rick.
We will remove the fence on Tract A and ensure that any new fence is within the Lot 1 lines. Accept
my apologies on this fence error and associated landscape.
Do you want the boundary fence removed that cuts across Tract A as it enters the retention pond?
Ie stops at the boundary of lot 1 and restarts at beginning of lot 2
Any landscaping will be relocated to lot 2 allowing for appropriate timing of its readiness- ie don’t
waste turf , plants and move when suitable if you can agree. It would not restrict any access as it is
as mainly grass.
The patios are in place over lap very slightly and request this be acceptable - and access is fine. Pls
confirm ok here
Regarding the storm water compaction it has been in place ever since I purchased the lots and
approx 5 years without any movement. It has had a lot traffic and no problems.
We would happily monitor it each year knowing we remain responsible for any issue after the
development as well. We prefer to not disturb it as it’s well settled.

Hi Rick,
Thank you for giving me the time to look into this situation. I’ll summarize
the details around Storm Line A in Tract A; essentially, the agreements
surrounding this storm sewer and Tract A haven’t been followed at
multiple points across the years and an agreement needs to be reached to
address the situation.
From the original Sunrise Ridge 2nd design, this sewer was intended
to be public within the easement on Tract A. Buildings (single
family homes) were to be 20’ or more from the sewer based on the
size of the tract and the adjacent lot line setback.
The 2018 Major Amendment proposed duplexes for the lots of
Sunrise Ridge 2nd including reduced setback requirements for Lots
1 & 2 adjacent to Tract A and Storm Line A.
The City agreed to the reduced separation from the sewer with the
conditions that:
The adjacent duplex foundation excavations would be
inspected, and backfill would be replaced and compacted
appropriately if bedding/storm sewer was exposed during
excavation.
Fences, window wells, enhanced landscaping, etc. would not
be allowable within Tract A .
The foundation excavation did indeed expose the storm sewer
based on City inspections. There were no inspections of the
backfill, bedding, or compaction around the storm sewer as the
excavator/builder did not call for inspections as agreed. The
excavator subsequently verified that bedding was not replaced and
compaction tests were not performed.
The updated development agreement (DA), previously attached
and again attached here, includes requirements for the owners of
Lots 1 & 2 to address the City’s concerns with the work around
Storm Line A.
The provided camera inspection does not constitute proper
documentation of backfill and compaction around the storm
sewer.
The current landscaping appears to consider Tract A as part of the
adjacent duplexes’ yards, rather than open space. Fences have
been placed within the tract, and it is anticipated homeowners will
continue to enhance the landscaping within these fenced areas by
planting trees, adding gardens, building sheds, and generally
making the storm sewer more difficult to access and maintain.
As this point, I believe there are two options:
1. Update agreements to have Storm Line A become privately owned
and maintained by the HOA. This would require an agreement
similar to the DA.
2. Remove all fences, patios, etc. from Tract A and return this area to
open space which would allow the City to maintain this sewer when
necessary in the future.
It appears the grading is sufficient based on the lot grading certification
provided, but Storm Line A must be addressed prior to Stormwater
signing off for CO.
Please let me know if you have any questions or would like to discuss
prior to moving forward with one of these options.
