Shear Engineering Corporation prepared a second final certification letter dated October 9, 2001. A copy of that letter is attached for immediate reference. Our initial certification was dated April 25, 2000. A copy of that letter is also attached for immediate reference. All sitework improvements have now been completed . All finished grading has now been substantially completed in accordance with the original approved MASTER GRADING PLAN and with the Grading Design revis ions in the area of Lots 27-33. All drainage facilities have been installed and are functioning appropriately and generally meet the intent of the original drainage design for Hearthfire P .U.D., First Filing in accordance with the original approved MASTER DRAINAGE AND EROSION CONTROL PLAN and with the Grading Design revisions in the area of Lots 27-33 . The three remaining items requiring attention at the time of our October 12, 2001 certification are now complete -and will be discussed in additional detail as follows : Issue 1: Final grading on the west side of Hearthfire Way The channel on the west s ide ofHearthfire Way has been completed and is now in conformance with the approved MASTER GRADING PLAN and the approved MASTER DRAINAGE AND EROSION CONTROL PLAN . Also in conformance with the Final Drainage and Erosion Control Report for Douglas Road prepared by Shear Engineering Corporation ; Shear Project No: 1552-01-96; Report dated September, 2000 . Page 7 of that report reads as follows : IV. DRAINAGE FACILITY DESIGN C. SPECIFIC DETAIL-SW ALE CAPACITIES The swale adjacent to Hearthfire Way will be regraded to meet the capacity requirements noted in the F inal Drainage and Erosion Control Report for Hearthfire P . U.D ., First Filing. The design flow and capacity for this swale is summarized below. The design flow is the l.33*Q l 00 to the upstream end of the proposed dual 36" culverts noted ab~ve. Collins, Colorado Issue 2: The pond overflow structure location The previous concern was that when the pond is operational with a working water surface elevation, overflow was not directed acceptably to the overflow structure only, and that there was a possibility of overflow waters inundating the emergency access drive . The overflow is functioning appropriately and generally meets the. intent of the original drainage design for Hearthfire P.U.D., First Filing. The emergency access drive has been corrected so that the drive sits approximately 12" above the pond overflow structure. Finished grading around the overflow structure guarantees that flows are directed to the overflow structure only. Attached is a print of Sheet 18A of 48 delineating the current finished condition . Issue 3: Improvements between Lots 27-33 and the pond north of Lots 27-33 It was determined that additional subdivision improvements were required in the area of Lots 27-33 due to conditions created by certain homebuilders. A modified grading and drainage improvement plan was prepared by Shear Engineering Corporation, constructed by Summit Excavating and As­ built by King Surveyors. A copy of the approved modified plan and a copy of the record drawing prepared by King Surveyors are attached for immediate reference. We would respectfully request that you release all remaining building permits with this final certification and the escrows provided. Collins, Colorado Dear Jay , This letter serves as final certification for the entire Hearthfire P.U .D ., First Filing. As we understand it, additional permits are being held by the Stormwater Utility due to the lack of a final certification. Please note that an initial final certification was provided April 25, 2000 . That certification identified several changes made in the field during construction and incorporated the documentation of those changes. That certification (with attachments) is included with this final certification for immediate reference. It is also made a part of this final certification. Generally, a majority of all sitework improvements have been completed. All finished grading has been substantially completed in accordance with the original approved MASTER GRADING PLAN except as noted in following discussions. All drainage facilities have been installed and are functioning appropriately and generally meet the intent of the original drainage design for Hearthfire P.U.D., First Filing in accordance with the original approved MASTER DRAINAGE AND EROSION CONTROL PLAN. Upon release of the initial final certification dated April 25, 2000, several field reviews were made by City of Fort Collins Stormwater Utility staff. There were two (2) major construction items noted by that did not necessarily meet the approved Utility Plans in the opinion of the Stormwater Utility. The first was the final grading on the west side of Hearthfire Way, the entry drive to Hearthfire from Douglas Road. Approved final design grading accommodates the anticipated offsite flows from the North side of Douglas Road as represented in the Final Drainage and Erosion Control Rep(m for Hearthfire P.U.D., First Filing. This grading had not been completed to the satisfaction of the Stormwater Utility . The second item involved the pond overflow structure location. The overflow structure was installed at a location south of the Equestrian I Pedestrian / Bike Trail. The plans represented the overflow box on the pond side (north side) of the Equestrian/ Pedestrian/ Bike Trail. The overflow box elevation appeared to be lower than the access drive elevation. Therefore, it was determined that the situation did not necessarily meet the intent of the approved plan. A third item has evolved since the original subdivision certification that was provided April 25, 2000. This issue involves several homes that were constructed with garden level and walkout conditions on Lots 27-33. Although the resulting conditions due to garden level and walkout basements are not the responsibility of the developer of Hearthfire P.U.D., First Filing, it appears that this condition, in part, has been made a condition of this final certification. The items in this area which are the responsibility of the developer and will be a final certification issue, are the finished subdivision improvements between these structures and the pond area. Collins, Colorado Issue 1: Final grading on the west side of Hearthfire Way The Stormwater Utility has offered two (2) allowable scenarios regarding this issue . The first alternative is to complete the grading to achieve conformance with the approved MASTER GRADING PLAN and the approved MASTER DRAINAGE AND EROSION CONTROL PLAN. The second alternative is to escrow for the amount that it would take to complete this task. The escrow alternative has been accepted due to the timing of improvements relative to the request for release of additional permits. Cost estimates for the performance of this work are being pursued at this time. The applicable escrow amounts will be provided to you immediately upon availability. Release of this escrow will be requested upon completion of the improvements. Issue 2: The pond overflow structure location The pond overflow structure has been relocated to the pond side (north side) of the Equestrian / Pedestrian / Bike Trail. Attached are the revised plan sheets representing the :reconstruction provided. The overflow is functioning appropriately and generally meets the intent of the original drainage design for Hearthfire P.U.D., First Filing. Issue 3: Improvements between Lots 27-33 and the pond north of Lots 27-33 It was recently determined that additional subdivision improvements may be required in the area of Lots 27-33. A portion of the Equestrian/ Pedestrian/ Bike Trail will be relocated to maintain the design separation from Lot 29. The required drainage swale in this area will be accommodated. Subdivision improvements will be completed between Lots 29 and 30 in Tract A. Specifically, the valley pan will be installed to its correct limits and minor re-grading will be performed from the end of the valley pan to the swale along the Equestrian / Pedestrian / Bike Trail. The drive will be lowered to allow runoff to cross over to pond according to the approved MASTER GRADING PLAN and the approved MASTER DRAINAGE AND EROSION CONTROL PLAN. Additional improvements proposed in our field meeting of Wednesday , September 26 , 2001 with the homeowners of Lots 27-33 and homeowner association representatives will be made only with the commitment of the individual homeowners to participate in the cost of those improvements . At this time, the cost of these improvements will be escrowed due to the timing of improvements relative to the request for release of additional permits. Cost estimates for the performance of this work are being pursued at this time The applicable escrow amounts will be provided to you immediately upon availability. Release of this escrow will be requested upon completion of the improvements. A copy of the plan for the proposed revised grading and additional improvements in this area, is attached for immediate reference and review. Shear Engineering Corporation has been involved during the entire construction process and has made several observations during construction. Field changes that Shear Engineering Corporation has been made aware of, have been documented by Shear Engineer.ing Corporation and will be addressed with this certification. Shear Engineering Corporation has also coordinated all field as-built data requirements. As­ builts and elevation shots were provided by Timberline Surveying, Inc. of Littleton, Colorado. All elevations are based on the same datum utilized with the Final Utility Plans for Hearthfire P.U.D., First Filing which were prepared by Shear Engineering Corporation; Shear Project No. 1552 -01-96; Date of approval by the Director of Engineering; 10/03/97. Please note that the subdivision datum does not match City of Fort Collins datum. The original survey was provided by Merrick & Company of Denver, Colorado. The datum difference is 3.38 feet. Please refer to attached memo prepared by Shear Engineering Corporation dated 10/12/99. This memo was prepared for Hearthfire P.U.D., Second Filing. However, it specifically addresses the datum issue. The following statement is in the attached memo: • 3.38' must be added to City datum in order to match the current Hearthfire P.U.D. datum. Therefore, 3.38' must be added to all current County Road 13 plan data, which was based on City datum. These revisions will be made now. All sitework improvements have been completed. All finished grading has been substantially completed in accordance with the original approved MASTER GRADING PLAN. All drainage facilities have been installed and are functioning appropriately and generally meet the intent of the original drainage design for Hearthfire P.U.D., First Filing in accordance with the original approved MASTER DRAINAGE AND EROSION CONTROL PLAN. There are two (2) significant field changes which have been made. These changes do not affect the intent of the original drainage design for Hearthfire P.U.D., First Filing in any way. They simply represent facility location changes which differ than those represented on the approved plans. The first change is related to the Overflow system located near the intersection of Hearthfire Way (The entrance to Hearthfire P.U.D. from Douglas Road) and Hearthfire Drive. Re­ alignment of facilities were provided during construction in order to salvage existing trees. Collins, Colorado The second change is related to the overflow system from the main pond to Richards Lake . The overflow box location was staked in the incorrect location. The location of the box resulted in the encroachment on Lot 47 of underground pipe. The location of the overflow box was noted fairly immediately after installation . As builts of the system were provided by Mr . Paul Meyer. Mr. Meyer provided the construction staking for Hearth.fire P .U.D., First Filing . As-builts were prepared in order to define the actual Lot 47 encroachments. Easements were prepared . There are several pieces of documentation associated with this issue. These are attached for immediate reference. Apparently, the easement was not recorded immediately . The easement has been recently provided to the County for recording. Date: 10/12/99 Shear Project No : 1552-02-97 Re: Project Elevation Datum There are three (3) different elevation datums associated with Hearthfire P.U.D . These are as follows: • Hearthfire P.U.D. main project datum utilized by Merrick with the overall Hearthfire survey. This is the datum that we will want to maintain . The elevation shows up on Merrick's Hearthfire P .U.D. Preliminary Grading Plan. • The Douglas Road datum for Douglas Road by King Surveyors based on a NGS benchmark located on Highway 1. The elevation shows up on King Surveying disk data and hard copy printout of Douglas Road field data. • City datum utilized by Shear and Frederick from City of Fort Collins documented benchmarks . Yet a fourth datum exists relative to Hearthfire P .U.D . The Richards Lake P .U.D . by Intermountain Engineering . Based on Paul Myer's documented level loop, Intermountain's datum does not meet either NGS or City datum . Based on a previous level loop by Frederick Land Surveying, the Intermountain Engineering datum is 1.525' higher than City of Fort Collins datum . This is not necessarily consistent with the known discrepancy in datum's between the City ofFort Collins and USGS . Based on the complete level loop provided by Paul Meyer (November 28 , 1997), the following has been determined . · • 3.38 ' must be added to City datum in order to match the current Hearthfire P .U.D . datum. Therefore , 3 .38' must be added to all current County Road 13 plan data which was based on City datum . These revisions will be made now. • 3 .00' must be added to NGS datum in order to match the current Hearthfire P.U.D . datum. Therefore , 3 .00' must be added to the Douglas Road datum . Plans for Douglas Road will not be adjusted for the datum change. However, a strongly worded note on the cover sheet will be required to address the datum discrepancy . • 1.84' must be added to Intermountain Engineering datum in order to match Richards Lake P.U.D. to the current Hearthfire P .U.D. datum . Therefore, 1.84' must be added to the Richard's Lake P.U.D . elevations (or subtracted from the Hearthfire P.U.D. datum) in order to coordinate Hearthfire P .U.D . with Richards Lake P .U.D . cc : Pam Brubacher Tom Kennedy; Hearthfire, Inc. Collins, Colorado Onsite meeting concerning the overflow structure in the lower pond This memo is a summary of our discussions and decisions concerning the overflow structure in the lower pond at Hearthfire P .U.D., First Filing on Wednesday, August 18 , 1998 . The original location of the structure was found to be in the wetlands . Therefore it was decided by the surveyor and Tarco personnel on site to move it approximately 24' south to get it out of the wetlands . When excavation began Whiting Petroleum gas lines were found that interfered with construction at the new location . I met with Brian, Faron and Paul Meyer and agreed that the box could be moved further sou~h. The proposed new location was to be at the upstream end of the pipe which was already laid on the day of our meeting . This new location came with the following stipulations . I. Paul Meyer would located the northwest property corner of Lot 47 and verify that the bike path could still be located south of the proposed box . This "warping" of the bike path was to be fie ld designed by Tarco and Paul Meyer. Mark asked that the closest edge of the bike path be a minimum of 5 feet from the overflow structure . It was agreed that if the end of the pipe caused the bike path to be located on private property, i.e . Lot 47 , that additional pipe would be laid to move the box north . 4836 S.
