Reynolds Companies 1600 Specht Point Drive Suite C Fort Collins, CO 80525 Dear Libby: As we have discussed, this letter is to retract and clarify my previous letter of December 23, 1997 regarding the Tower Shoppes at Pinecone PUD. Specifically, I was in error stating that you only had until this summer to complete this PUD. As part of an approved Overall Development Plan (ODP) which is larger than 100 acres and which has the infrastructure in place to serve at least 20% of the ODP approval, this PUD falls under Ordinance 161, 1997. As such, the Tower Shoppes PUD will remain valid until January 17, 2000. If the project is not completed in this time frame, the both the ODP and the PUD will expire and any subsequent development requests will be processed under the Land Use Code. Likewise, should an amendment to the PUD be requested which changes the character of the development, it will be processed under the Land Use Code rather the same regulations the project was originally approved under (ie. the Land Development Guidance System). -- __.In addition to this clarification, you asked that I clarify two additional questions: Can the "in -line" shops contained in the Tower Shoppes PUD be developed without the adjoining anchor store? Yes. This would not affect the approval status of the anchor store itself. What is the status of the remaining portions of the Horsetooth East Business Park? Because the remaining pads located in the Horsetooth East Business Park have preliminary PUD approval only and they are part of an ODP less that 100 acres which has the infrastructure in place to serve at least 20% of the approved ODP, there is a deadline of July 17, 1998 by which a completed final PUD application must be filed with the City. If this deadline is not met, all future development applications will be processed under the Land Use Code. I trust this clarifies the misunderstanding caused by my earlier letter.
