Howes Street Fort Collins, CO 80521 Subject: Review Process- Prospect Industrial Park, Lot 32, Midpoint Self -Storage PDP #28-98B. Dear Mr. Goddard: I have received your letter dated February 21, 2001 where you had requested information on the name of the designated hearing officer and date of the public hearing. No date has been set for the administrative public hearing and may not be until a Modification of Standards to Land Use Code Division 3.2.1(F), Tree Protection and Replacement has been approved or a revised plan is submitted that retains the tree in question. This standard requires that "existing significant trees shall be preserved to the extent reasonably feasible". I've attached an application form for the modification request should you decide to pursue the application. The applicant will need to submit the completed application form, 10 sets of development plans, and a written statement addressing how the review criteria, set forth in Division 2.8(H) of the Land Use Code, are met. Authority to approve a Modification of Standards request lies with the Planning and Zoning Board, not a hearing officer. In order to approve the request, the Planning and Zoning Board must find that it meets the review criteria. The applicant has two options at this point: 1) prepare a consolidated application (Modification of Standards/PDP) to be reviewed by the Planning and Zoning Board; or 2) split the application into a request to Planning and Zoning Board for the Modification of Standards and, once the Modification is approved, forward the PDP application to the hearing officer for a decision. 281 North College Avenue • PO.
