It appears there are a couple of things we had asked for that we should really get before we can support approval of the ODP. The floodplain wasn't shown on the ODP but was on the drainage plan in the report they submitted and the other issue was their outfall was to an irrigation ditch which is not normally allowed. I have copied Basil's comment below. The drainage report currently recommends that the flows from this site are to be routed to the Cache La Poudre Inlet Ditch Currently City drainage criteria prohibit the use of irrigation canals as the ultimate outfall for a development unless that is recommended by the drainage master plan. This area is for the most part outside of any of the City's identified and master planned drainage areas. If the ditch is to act as the final recipient of drainage flows from this area then not only a ditch agreement would be necessary, but also agreements between the City and the ditch company over the long term maintenance and operation of the ditch otherwise outflow into the ditch would not be allowed. The overtopping of the ditch by historic flows that happens now on the ditch cannot be allowed to continue once this site is developed as this site will markedly increase the amount of flow into the ditch. Even if historic rates are maintained volumes of water will be significantly increased once this site is developed. It is recommended that before this project get ODP approval outlines of agreements between the developers of this site and the City be developed We recommend a meeting with the developers to evaluate possible drainage alternatives that would be acceptable to the City. Since that first submittal the developer has not contacted us to work this out. Years ago I had met with Dallas Horton and he was pursuing an alternative outfall via the County borrow ditch system. He must have decided to that was too much work and proposes to use the irrigation ditch. We do not have agreements with that ditch company and we don't really want to get involved with their ditch maintenance by putting "City' drainage water into it. Also we have now adopted a floodplain with a floodway which should help him but it needs to be shown on the ODP. Both Paradigm and Interstate Lands have worked with us to come up with an ODP that seems realistic to pursue but they haven't even tried.
