In my prior correspondence to you, we talked about public/private cooperation on
Prospect Interchange as being the first step in creating a powerful economic engine and
attractive gateway into the City that will benefit all of Fort Collins for many decades to
come.
Now our ODP is at an impasse over these two plugs.
We request a meeting with you and appropriate City staff to seek a resolution to what
appears to be the unauthorized plugging of these culverts AND our need for additional
extensions to this ODP. Several other effected landowners have asked to participate in
this meeting.

I represent the applicant for the I-25/Prospect ODP which was submitted to the City of
Fort Collins on June 10, 2003. This ODP sets the stage for a major retail project and
business park at the Prospect interchange.
In working on this project, I met with CDOT concerning a "newly mapped" flood plain
which increases the flood plain effecting this ODP from about 4 acres (per 1999 maps) to
about 85 acres (per recent City maps) primarily due to storm water backing up east of
"four culverts" under I-25 (on the west boundary of this ODP, '/2 mile north of Prospect).
I learned from Carla Harding at CDOT that the existing four culverts were installed in the
mid -eighties and two of the four were plugged at the request of Roger Krempel, a former
City engineer. According to discussions between CDOT and Bob Smith in City storm
water (as also confirmed with Carrie Daggett in the City attorneys office), there are no
written records of any kind concerning these culverts. Consequently, in a conference
today, Dallas Horton asked Carla Harding at CDOT to open the two plugs so storm water
would be allowed to follow its natural and historical course.
Bob Rudolph and Larry Rudolph, whose family owned the subject property from 1914
to 1973 and continued to lease it until 2000, confirmed that their family received no
notice and were not consulted regarding the construction and plugging of these culverts.
Because the City's new maps show that these `Plugs" interfere with the natural and
historical drainage of our property, Carla Harding is sending you a letter regarding the
opening of these culverts.
Cameron Gloss who has granted two extensions of our ODP processing to allow us the
time needed to resolve these drainage issues, has sent us notice that our ODP will lapse if
these issues our not resolved by January 15, 2004.
