The site is located approximately 3/4 of a mile south of Harmony Road and east of Shields Street. The zoning is R-L-P, Low Density Planned Residential. RECOMMENDATION: Approval EXECUTIVE SUMMARY: The Preliminary Subdivision was approved, with conditions, on December 18, 1989. The lot sizes and lot widths exceed the minimum requirements of the R-L-P zone district. Conditions pertaining to fire access, street variances, and landscape plans have been satisfied. A plat note has been added to require a review by the City Forester to preserve existing trees insofar as possible. The Final Subdivision is in substantial conformance with the Preliminary. Background: The surrounding zoning and land uses are as follows: N: R-L-P; Existing single family homes (Clarendon Hills First Filing) S: FA-1; (County) Existing single family homes (Applewood Estates) E: FA-1; (County) Large lot single family homes W: R-L-P; Existing single family homes (Clarendon Hills Second Filing) The site was annexed in 1989 as Orchard First and Second Annexations and was zoned R-L-P, Low Density Planned Residential. There is no condition that all development proceed as a P.U.D. The site is a former apple orchard. 2. Land Use: The only requested land use is single family homes which is a use by right in the R-L-P zone district. All lots in the subdivision exceed the 6,000 square foot minimum lot size and the 60 foot minimum lot width as measured from the building line. Lot sizes range from 12,481 to 31,162 square feet. 3. Conditions of Approval: There were three conditions attached to the Preliminary approval. These conditions and their resolution are described below: A. First Condition: "A second point of access acceptable to the Poudre Fire Authority be obtained, or Lots 12 through 17 must be provided with automatic fire extinguishing systems." A fire lane, denoted as Tract A, has been platted between Lots 17 and 18. Tract A is noted on the Plat to be used for emergency fire access only and to be maintained by the Clarendon Hills Homeowner's Association. The fire lane has been designed with cooperation from the Poudre Fire Authority and includes two vehicular gates with chains, two pedestrian gates, asphalt paving, and landscaping. The lane connects Abbey Road to Paradise Lane in Applewood Estates. This fire lane has been reviewed and accepted by the Applewood Homeowner's Association. B. Second Condition: "Street Standards be met or variances be obtained for non-standard street design." 0 • The Orchard at Clarendon Hills, Final Subdivision — #47-89C March 26 1990 Planning & Zoning Board Meeting Page 3 The applicant has provided the necessary documentation to the City Engineer as part of the request to vary two standard requirements. First, the design speed of 25 m.p.h. with a centerline radius of 165 feet has been evaluated and approved. Second, a local street width consisting of 28 feet of pavement on a 46 foot right-of-way has also been evaluated and approved. C. Third Condition: "Final Landscape plans be submitted addressing landscaping features and fencing." The applicant has submitted a separate landscape sheet that describes, in detail, the project entry landscaping, the fire lane landscaping, the detention pond landscaping, and the typical individual lot landscaping along the street frontage. In addition, a note has been added to the landscape plan indicating that fences along the southern property line (Lots 16 through 21) will be specified as three rail, split rail fence which will preserve the open character of the adjacent subdivisions. 4. Tree Preservation: The plat document contains a note that requires the applicant of a building permit to provide information to the City Forester regarding the number and location of existing trees on each lot. The City Forester may recommend any combination of preservation, pruning, removal or replacement of said trees. While it is recognized that the construction of streets, homes and driveways will necessitate the cutting of trees, it is acknowledged by the City that the large number of trees represents an outstanding natural feature that should be preserved insofar as possible. The legal justification for preserving outstanding natural features is found in Section 29-656 (d) (Design Standards) of the City Code: "Outstanding natural and cultural features such as scenic spots, watercourses and historic sites and buildings shall be preserved insofar as possible." RECOMMENDATION Staff finds that the request for Final Subdivision for The Orchard at Clarendon Hills is in compliance with the requirements of the R-L-P zone district and in substantial conformance with the approved Preliminary Subdivision. The three conditions of Preliminary approval have been satisfied. Staff, therefore, recommends approval. Services epartment MEMORANDUM TO: Planning and Zoning Board FROM: Ted Shepard, Project Planner RE: Orchard at Clarendon Hills, Final, Condition of Approval DATE: March 23, 1990 On the advice of the City Attorney, it is recommended that the following condition of approval be read into the record for The Orchard at Clarendon Hills Final Subdivision: "The final utility plans shall demonstrate sufficient easement widths for the conveyance of storm drainage flows so that there is no detrimental alteration to or encroachment upon the existing bridal path easements that are on record and platted along with the Applewood Estates Subdivision."
