Dear Mr. Hooper,
This letter is in response to your letter of November 30, 1989, expressing
concerns about the Frontage Road Industrial Associates, Ltd.. Annexation and
Zoning request to the City of Fort Collins.
The Fort Collins Planning Department is well aware that this annexation is
located within the "Vine Corridor," one of many potential alternative locations
for the Fort Collins Expressway east of State Highway 287. While the
"expressway" is an important future transportation planning consideration to the
community, the annexation of this property is a part of a larger comprehensive
growth management strategy being completed under the policies and agreements
between the City of Fort Collins and Larimer County, commonly known as the
Urban Growth Area Agreement. Annexation of property in the 1-25 Corridor"
is part of the implementation of important land use planning and economic
development related issues.
Your letter relates fears that the annexation of this property will be a prelude
to development and could possibly drive up potential costs of land purchases
by the State Division of Highways for the expressway. The property is
currently zoned "I -Industrial" in the County. The I zone allows all types of
industrial land uses. The property will be zoned "I-L, Limited Industrial" in
the City. Therefore, there is no change in "anticipated" use of the subject
property. However, the City I-L zoning will be further restricted with a
planned unit development (PUD) condition. In the County, the property could
develop with several "uses -by -right" without further general public review. In
the City, any development proposal would require a public hearing and action
by the Fort Collins Planning and Zoning Board. The State Division of
Highways would also be notified of any pending development.
In the case of this particular property, the concerns expressed in your letter
are perhaps better covered by the actual annexation of this property into the
City rather than leaving the property under County development regulations.
If the property begins to develop; then that would be the appropriate time to
address such concerns as expressed in your letter. Without 'official"
designation of the expressway corridor through this property, the City, or the
State Division of Highways, could be "taking" property rights of the land
owner, ie. limiting or restricting the use of property without just compensation.
