Todd‐ See below. I’m assuming this serves as the start of the conversation but apparently, there is no formal LOI. It
sounds like it’s a work in progress.

Folks,
I’m writing with an update on our communication w/ BNSF for the Block 23 redevelopment.
BNSF LOI
Below is what Amber Stoffels w/ BNSF was willing to send when I asked her for an “LOI”. We’ll
continue to work with BNSF as our design progresses.
WORK IN ROW
The last time Claire Havelda & I spoke, Claire asked me to reach out to BNSF to discuss the work on
the City’s property along the south side of Cherry St where we are going to improve the City’s ROW
across BNSF’s tracks (sidewalk, tree lawn). When I subsequently spoke to Amber, she redirected me
to Brad Buckman. Last Friday, 10/23, Brad, Spencer Smith, and I had a good conversation about
how the communication needs to flow to get this work approved and completed. We agreed that
the next step was to schedule a meeting on site w/ the City, Amber, and the PUC (I forget the lady’s
name w/ the PUC – Brenda maybe?). The thought was that this could happen sometime in
November. I think Brad is setting this up.
OTHER CONSIDERATIONS
On the call w/ Brad & Spencer, the question was raised as to whether the City would need any sort
of written agreement or easement with BNSF for the improvements in the City ROW. I suspect we’ll
need Claire’s opinion on this item.
On the call w/ Brad & Spencer, someone mentioned that BNSF may have plans to raise the elevation
of their track across the site. This may impact the engineering for our project. We’ll ask about this
at the on‐site meeting in November.
Also at the on‐site meeting, we’ll ask about any approvals or agreements required for the City ROW
work we’ll be performing as we rebuild the sidewalk at the SW corner of Cherry & College. We’re
not crossing the track here, but we’ll need to get into BNSF’s “personal space” to construct.
I’ll continue to keep everyone in the loop as we progress. Thanks for your help and have a good
weekend!

Jerry,
Glad we were able to connect today. Please move forward with sending over the engineering plans so
we may complete our engineering review of potential impacts to BNSF. Appreciate the time and will
continue to be in touch as the project progresses.
