Resolution 90-21 Finding Substantial Compliance and Initiating Annexation
Proceedings for the Maxwell Annexation.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The City of Fort Collins purchased a portion of the Maxwell property,
located on the foothills west of the city, in the mid-1970's. The
property, located northwest of the CSU football stadium is approximately
168.23 acres in size and is eligible for annexation through a provision in
State law which allows land owned by the State or Federal governments to be
ignored for the purposes of determining contiguity.
The proposed Resolution makes a finding that the petition substantially
complies with the Municipal Annexation Act, determines that a hearing
should be established regarding the annexation, and directs that notice be
given of the hearing. The hearing will be held at the time of first
reading of the annexation and zoning ordinances. Not less than thirty days
of prior notice is required by Colorado law.
The property is owned by the City of Fort Collins and is located outside
the Fort Collins Urban Growth Area. According to policies and agreements
between the City of Fort Collins and Larimer County contained in the
Intergovernmental Agreement for the Fort Collins Urban Growth Area, the
City can consider the annexation of property outside the UGA by giving the
County proper notice and justification for the annexation. The City has
recently annexed other City -owned open space areas along the foothills when
they satisfied the contiguity requirements. The property gains the
required 1/6 contiguity to existing city limits from a common boundary with
the Becksted Annexation and the Third Foothills Annexations to the east.
PLANNING AND ZONING BOARD RECOMMENDATION:
Fhe Planning and Zoning Board will conduct a public hearing on the request
for annexation and zoning at its regular monthly meeting on February 26,
1990 and will make its recommendation at that time. The Board's
recommendation will be forwarded to the City Council in time for the public
hearing and first readings of the annexation and zoning ordinances.
RESOLUTION 90-21
OF THE COUNCIL OF THE CITY OF FORT COLLINS
INITIATING ANNEXATION PROCEEDINGS FOR THE
MAXWELL ANNEXATION
WHEREAS, the City of Fort Collins is the sole owner of certain real
property to be known as the Maxwell Annexation; and
WHEREAS, the Council of the City of Fort Collins desires to initiate
annexation proceedings in accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the Council of the City of Fort Collins hereby
desires to initiate annexation proceedings in accordance with law for that
certain property to be known as the Maxwell Annexation, more particularly
described as situate in the County of Larimer, State of Colorado, to wit:
The Northeast 1/4 of the Northwest 1/4 of Section 20, Township 7
North, Range 69 West of the 6th P.M., less Tract "B" as described
in Book 910, Page 155 of the Larimer County, Colorado Records,
And also the Northwest 1/4 of the Northwest 1/4 of Section 20,
Township 7 North, Range 69 West of the 6th P.M., and also the
Southeast 1/4 of the Northwest 1/4 of Section 20, Township 7
North, Range 69 West of the 6th P.M., less Tract "C" as described
in Book 910, Page 155 of the Larimer County, Colorado Records,
And also the North 1/2 of the Northeast 1/4 of the Southwest 1/4
of Section 20, Township 7 North, Range 69 West of the 6th P.M.,
and also a square tract of land 120.00 feet on a side, located in
the South 1/2 of the Northeast 1/4 of the Southeast 1/4 of said
Section 20, the North side of the tract being on the boundary of
said South 1/2 of the Northeast 1/4 of the Southwest 1/4 of
Section 20 and the East side of the tract being 500.00 feet
westerly of the East boundary of said South 1/2 of the Northeast
1/4 of the Southwest 1/4, less the West 1/2 of the Northwest 1/4
of the Northeast 1/4 of the Southwest 1/4 of Section 20, and less
part of Tract "C" as described in Book 910, Page 155, Larimer
County Records,
And also the Southwest 1/4 of the Northwest 1/4 of Section 20,
Township 7 North, Range 69 West of the 6th P.M., less the land
described in Book 1182, Page 409 and less the land described in
Book 849, Page 242, Larimer County, Colorado Records.
This land is more particularly described by a boundary survey by
the City of Fort Collins as:
A tract of land situate in the West One -Half of Section 20,

Quarter of said Section 20 as bearing N 84°42'57" E and with all
bearings contained herein relative thereto is contained within
the boundary lines which begin at the North quarter corner of
said Section 20 and run thence S 00°11'40" W 1350.14 feet to the
Southeast corner of the Northeast Quarter of the Northwest
Quarter of said Section 20, thence S 00012'30" W 2032.08 feet to
a point on the East line of the Southwest Quarter of said Section
20; thence S 87021'40" W 500.25 feet; thence S 02°40'18" E 120.17

Section 2. That the Notice attached hereto be adopted as a part of
this Resolution. Said Notice establishes the date, time and place when a
public hearing will be held regarding the passage of an annexation
ordinance pertaining to the above described property. The City Clerk is
directed to publish a copy of this Resolution and said Notice as provided
in the Municipal Annexation Act.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 20th day of February, A.D. 1990.

NOTICE
PLEASE TAKE NOTICE that the City Council of the City of Fort Collins
has adopted a Resolution initiating annexation proceedings for the Maxwell
Annexation, said Annexation being more particularly described in said
Resolution, a copy of which precedes this Notice.
That, on April 3, 1990, at the hour of 6:30 p.m., or as soon
thereafter as the matter may come on for hearing in the Council Chambers in
the City Hall, 300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins
City Council will hold a public hearing upon the annexation petition for
the purpose of finding and determining whether the property proposed to be
annexed meets the applicable requirements of Colorado law and is considered
eligible for annexation. At such hearing, any persons may appear and
present such evidence as they may desire.
