PROJECT DESCRIPTION:
A request for preliminary and final approval for a 12 child day care center in
an existing residence. The site is located at 1218 Elm Street and is zoned R-L,
Low Density Residential.
RECOMMENDATION: Approval.
EXECUTIVE SUMMARY:
The applicant proposes a day care center for 12 children in an existing
residence. No changes are proposed to the existing residence to accommodate
the proposed day care center. In addition to the applicant, one employee will
work at the center.

NEIGHBORHOOD MEETING SUMMARY

QUESTIONS, CONCERNS, COMMENTS
1. Will the increase from 6 to 12 children cause additional traffic?
RESPONSE: Yes, there will be a slight increase in traffic. The six children
now are served by 3 trips. The additional six children will be served by a
maximum of six additional trips. Because we often serve siblings, this new
amount of traffic may be reduced. The arrival time of the children is staggered
based on parent's work schedule so all the cars will not be arriving at the same
time.
2. Is parking and drop-off area adequate?
RESPONSE: Yes, the house has a double car driveway with the length of two cars..
3. Is there adequate outside play area and will it be fenced?
RESPONSE: Yes, the outdoor play area will measure 2,900 square feet which
exceeds both City and State standards, and is presently secured with a six foot
solid wood fence.
4. How long have you been in the daycare business?
RESPONSE: I have been licensed for four years.
5. What are the hours of operation?
RESPONSE: The hours will be approximately 6:00 A.M. to 5:30 P.M. Two children
are watched in the evening to accommodate the parent's work schedule.
6. Have you ever been written up by the State or found to be not in compliance
with any relevant code or regulation?
RESPONSE: No.

7. Where do your present children come from?
RESPONSE: Two from Wellington, two from the Tavelli School area, and two
from the Putnam School area.
S. Any weekend activity?
RESPONSE: Yes, one child is watched on Saturday and one is watched on Sunday.
9. What about signage and floodlights?
RESPONSE: There will be no signage. There are no floodlights, just regular
lights above the front door.
10. Are there any other daycares in the neighborhood?
RESPONSE: Yes, at the corner of Pearl and Sycamore.
11. What are the ages of the children?
RESPONSE: The State license restricts the ages to 2-13.
12. Will there be any exterior remodeling?
RESPONSE: Yes, a second exit door will be added to meet State Code.

COMMENTS
1. Background:
The surrounding zoning and land uses are as follows:
N: R-L; existing single family residences (Hanna Subdivision)
S: R-L; existing single family residences (Hanna Subdivision)
E: R-L: existing single family residences (Hanna Subdivision)
W: FA; vacant (in unincorporated Larimer County)
2. Land Use:
The proposed use consists of a day care center for 12 children. The applicant
also lives at the site and currently operates a day care home. A child or day
care center, as defined in the City's Zoning Code, is a facility maintained for
the whole or part of a day for the care of 7 or more children under the age
of 16 years and not related to the owner, operator or manager". The City's
definition of a day care home limits the maximum number of day-care chil-
dren (including the caretaker's own children) to 6. Two additional school -age
children may be cared for on a before -and -after school basis). Thus, a PUD is
necessary to expand the existing day care home to more than 6 children.
The State of Colorado has two classifications of day care: the day care home
(for up to 6 children) and the small day care center (for up to and including
12 children). Licensing requirements for centers of more than 12 children are
very extensive and require a different occupancy rating. As a result, the
typical day care centers has a much larger capacity than 12 children.
Child or day care centers are defined as a residential use under the Residen-
tial Uses land use category of the LDGS. However, since The Residential
Density Chart is applicable only to calculating residential density (DU/acre),
the point chart was not used to evaluate this proposal. The proposal for a
small day care center in an existing residence at this location does meet City
land use policies of being located within and adjacent to residential areas,
in the proximity of a neighborhood park (Lee Martinez Park), and a school
(Putnam Elementary).
The site is located in the West Side Neighborhood, in an area identified as a
"conservation area" on the West Side Neighborhood Plan. These areas are
primarily single family residential and the intent is to retain a low density
residential character. The use of an existing residence for the proposed day
care, as well as the minimal impact of this proposal, makes it consistent with
the West Side Neighborhood Plan.
3. Design:
The day care center is proposed in the existing home. The only change
planned is the addition of a second exit door at the rear of the home. The
play area for the day care is in the backyard and is enclosed with a 6' fence,

as required by City Code. A minimum of 2,500 square feet of outdoor play is
required for 15 or fewer children and 40 square feet per child (or a total of
480 square feet) is required for indoor space. The applicant's fenced outdoor
area (2,752 square feet) and indoor space (904 square feet) exceed these
requirements. The applicant is providing a deciduous tree in the front lawn
area, to improve the site's streetscape.
One employee would assist the applicant in the day care operation whenever
there are more than 6 children in attendance, as required by State licensing
requirements. Parking for the applicant is in the existing garage. One parking
space in the driveway would be used by the employee, leaving the remainder
of the drive space for parents to use in dropping off children. Based on the
applicant's current day care schedule (see attached), there are three trips made
to the site in the morning and three trips made late in the afternoon. Two
trips are made to and from the site for children that are cared for through
the night. With the proposed additional capacity, a maximum of 6 additional
trips could be expected each way. The nature of home day care is that atten-
dance times are extremely varied and as is the current situation in this day
care home, the peak time is not at the traditional 8AM and 5PM hours. Most
large day care centers operate on a standardized 6AM - 6PM schedule. The
amount of parking and drive space appear adequate to support the proposed
day care center, without impacting the surrounding neighborhood and street.
4. NeiQhborhood Compatibility:
A neighborhood meeting was held on December 11, 1989 on this proposal.
Notices of the neighborhood meeting were sent to 142 property owners. Two
persons attended the meeting. Questions raised related to the operational
aspects of the existing day care home, as well as the proposed day care center.
The proposed day care center in an existing residence is compatible with the
surrounding area.
RECOMMENDATION
Staff finds that the Elm Street Day Care PUD, Preliminary and Final meets
the criteria of the All Development Chart of the Land Development Guidance
System, is consistent with the adopted West Side Neighborhood Plan and is
compatible with the surrounding area. Therefore, staff is recommending
approval of Elm Street Day Care PUD, Preliminary and Final, #64-89.

Larimer County Landfill Rezoning Conditions
DT: February 23, 1990
Staff is recommending the following conditions on the Elm Street Day Care
PUD, Preliminary/Final:
1. The existing trash receptacle be relocated to the southeast corner of the
garage and screened with a 6' cedar screen to match the existing fence.
2. Signage for the day care be limited to a maximum of two (2) square feet.
Any request for additional signage must be approved by the Planning and
Zoning Board.
Staff is recommending the following conditions for the Larimer County
Landfill Rezoning, with the noted wording change on condition #2:
I. Additional right-of-way be dedicated for one-half of the arterial street
standard (total of 50' from centerline) and that the site design for the
landfill take into consideration the planned widening of the street.
2. The existing curb cut on Taft Hill Road be relocated, to provide a safe
access point for the existing landfill and future curb cuts on Taft Hill
Road be sited to provide adequate sight distance.

DT: February 22, 1990
There is an existing trash receptacle located at the southwest corner of the site,
at 1218 Elm Street. The applicant has agreed to relocate this receptacle to the
southeast corner of the garage (see attached location) and screen it with a 6'
cedar screen to match the existing fence. Since this has not been reflected on
the site plan, staff is recommending the following condition:
"The existing trash receptacle be relocated to the southeast corner of the garage
and screened with a 6' cedar screen to match the existing fence".

To Whom it may concern;
In the process of changing my daycare home from six
children to twelve children there will be no changes to site,
with the exception of a second fire exit. There will be no
new pavement or building coverings.

in my driveway.
As for any concern about my being able to handletwelve children,'
Iwill have a full time assistant whenever I have seven or more
children.
