The property is zoned rlp, Low Density Planned Residential and is Tract C of the Amendment of the Villages at Harmony West Overall Development Plan. Tract C is Lot One of the Fort Collins Second and Harmony PUD plat which is part of this project. RECOMMENDATION: Approval with condition EXECUTIVE SUMMARY: This project consists of a request for final PUD approval for a 15,660 square foot church on Lot one of the Fort Collins Second and Harmony PUD. The church site is approximately 3.00 acres with an additional 0.2 acres reserved for future parking and a future access drive onto Regency Drive. The proposed use is in substantial conformance with the approved Amended Overall Development Plan of the Villages at Harmony West and the approved preliminary PUD. Conditions of approval concerning storm drainage issues and street improvements for the Harmony Road frontage have been met. A note has been added to the plans stating that if there is any change of use or added use to this particular church, then it must come back to the Planning Department to have the traffic impacts reviewed. Please note the following additions or changes to the following Staff reports: 1. For Items #2 and #6 on the Agenda, (Blevins Court PUD #42-91B and Oakridge PUD 10th Filing #13-82AZ), please add the following condition to the recommendations for approval: That the Development Agreement for the planned unit development be negotiated between the developer and City staff and executed by the developer, and that the utility plans be fully executed and approved by the City prior to the next monthly meeting of the Planning and Zoning Board; or, if not so executed, that the developer, at said next monthly meeting, apply to the Board for an extension of time. If the staff and the developer disagree over the provisions to be included in the Development Agreement and/or utility plans, the developer may present such dispute to the Board for resolution if such presentation is made at the next succeeding monthly meeting of the Board. The Board may table any such decision, until both the staff and the developer have had reasonable time to present sufficient information to the Board to enable it to make its decision. (If the Board elects to table the decision, it shall also extend the term of this condition until the date such decision is made.) On Item #8, Kingston Woods PUD #58-91A, the applicant has agreed to put a note on the plans to allow a 4' high fence, of open construction, either a shadow box or split rail design, along the north edge of the detention pond in the northeast corner of the property. The applicant has agreed to specifically exclude a 6' high solid wood fence in this location. 3. On Item #10, Fort Collins Second and Harmony at the Villages at Harmony West PUD # 3-90F, the applicant has agreed to put a note on the site and landscape plans to restrict the 42" high, steel, chain link fence to the parking lot area (along the north and east property lines only) where the fence can be well landscaped. A 42" high, dark colored, vinyl clad (coated wire) fence will be provided in the front lawn area (along the irrigation canal) south of the parking lot at the southeast corner of the property. 0 • Fort Collins Second at Harmony West Lot April 27, 1992 P & Z Page 2 COMMENTS: 1. Background and Harmony 1 - Final - Meeting PUD at the Villages #3-90F The surrounding zoning and land uses are as follows: N: rlp; Tract D-2 of Villages at Harmony West ODP (future residential) and City regional detention pond S: RLP; Existing residential (The Ridge Subdivision) E: rlp; Vacant (Pineview PUD ODP) W: rlp; Existing residential (Regency Park PUD and Belair PUD) This property was annexed into the City of Fort Collins with the Horsetooth-Harmony West Annexation in 1980 and master planned for business service uses as Tract C of the Villages at Harmony West Overall Development Plan in 1982. Tract C was amended to allow church uses and a preliminary PUD was approved by the Planning and Zoning Board in March of 1992, with conditions regarding storm drainage and improvements to Harmony Road. 2. Land Use The proposed use consists of a 15,660 sq. ft. church on the 3.0 acre site with an additional .2 acres reserved for future parking and an access drive off of Regency Drive. This use is in conformance with the approved Villages at Harmony West Overall Development Plan and is in substantial conformance with the approved preliminary plan. Churches are allowable uses in residential zones and are considered to be compatible land uses and can serve as good transitional uses between residential and business or commercial uses. 3. Design The orientation of the church is towards Harmony Road. The church is situated central to the site with perimeter parking and landscaping. Perimeter landscaping is a combination of evergreen and deciduous trees and shrubs, and ornamental trees. A variety of evergreen and deciduous shrubs and flowering vegetation is planned as foundation plantings and along walkways. The applicant will escrow funds for any street landscaping which will be planted after the Harmony Road improvements are constructed. Fort Collins Second and Harmony PUD at the Villages at Harmony West Lot 1 - Final- #3-90F April 27, 1992 P & Z Meeting Page 3 The church is set back approximately 80 feet from the flow line of Harmony Road. The building is two tones of gray brick with wood frame windows and white trim. The alcove areas are a synthetic off-white stucco material. The building will be roofed with an asphalt shingle in a gray -blue or black. A 4' by 3' stone sign with incised letters is located on the south side of the building. No monument sign is proposed. Parking lot and building security lighting is down directional and will not spill off the site. The trash receptacle, located in the northeast corner of the site, will be enclosed. Building materials for the trash enclosure and the small storage shed will match the church. The storage shed will feature a sloped roof with asphalt shingles to match the church. 4. Neighborhood Compatibility No neighborhood meeting was held. Churches are permitted uses in residential zones and Staff believes they provide good transitional uses between residential and business service or commercial uses. 5. Transportation The church would have two points of access on Harmony Road. The Church of the Latter Day Saints has a policy which does not allow schools or day care uses in their churches, which would create additional traffic impacts in the future. Therefore, the Transportation Department does not have a concern with the two access points on Harmony. Peak hours for the church do not conflict with the peak vehicular activity on Harmony and Regency. A condition of approval, that any change in use of or addition to this church would require prior review by the Planning Department in order to review the traffic impacts on Harmony Road, has been met, by including a note to this effect on the plans. The section of Lot One which fronts on Regency Drive is reserved for future parking and access. The lot is platted to dedicate this section as an access, utility and drainage easement to allow cross access for Lots 2 and 3. Transportation has stated that Lot 2 will likely not have access on Harmony Road because of the proximity to the intersection of Harmony and Regency. The developer will be required to escrow funds for additional widening and improvements for Harmony Road, including lengthening the box culvert for the canal crossing at the southeast corner of the site. These responsibilities will be addressed in a development agreement between the City and the owners and Fort Collins Second and Harmony at Harmony West Lot 1 - Final - April 27, 1992 P & Z Meeting Page 4 PUD at the Villages #3-90F developers of the property. At the time that the Regency access drive is constructed, the developer will be responsible for improving the frontage on Regency Drive. A condition of approval, that a preliminary design for the Harmony Road frontage from Regency Drive to east of the Pleasant Valley and Lake Canal, including the canal crossing, be approved by the City Engineer, has been met. 6. Storm Drainage The Stormwater Utility condition of approval, that the applicant address all stormwater issues which have not yet been resolved, including the off -site stormwater improvement designs for Lot 2, design for the relocated emergency spillway, and canal crossing box culvert sizing details, has been met. RECOMMENDATION: The proposed project is in substantial conformance with the existing Overall Development Plan for the Villages at Harmony West and the approved preliminary PUD.
