Mulberry Street Fort Collins, CO 80521 Dear Larry, I have reviewed with our staff the concerns raised in your letter of January 29 about your proposed development on a thirty acre site known as The Platt Property. I can answer some of your questions in this letter, however, I would like to meet with you to discuss some of the major issues which you have identified as impediments to this development. First of all, the City is aware that Troutman is an important street that will have to be built to serve development in this area. Although the new schools put a strain on the roadway system, they have complied: with the State statutes that regulate their activities. City staff believes that thirty (30) homes may be built along Wakerobin without the requirement of constructing either Seneca Street or Troutman Parkway. However, the Planning and Zoning Board will make the final decision. You must be aware that access on Shields Street and Harmony Road may be congested at times. The repay agreement for the streets in this area with the School District was delayed by the City with the knowledge of the School District. The City will honor the $66,000 street repay and the sanitary sewer repay. The Home Federal repay of $8,000 was found shortly after the City meeting with The Group, following a search of records to ensure that all repays and records were correct. One of the main reasons for the meeting with the City's Development Coordination team is to research proposed projects after such a meeting. Regarding Platt's alleged exemption from repays between Platt and the District, we have not found any written agreement in' our records. The District has indicated that they did not sign, nor did they ever agree to exempting Platt. If you have such a written agreement, we would appreciate having copies of such documents. We will participate in our percentage of street oversizing (available in the fiscal year).. Unfortunately, the City currently does not have a capital project budgeted to build Troutman and the City's policy is to build needed arterial streets, not collectors like Troutman. We would therefore, expect development to dedicate the right-of-way and build the road with some participation by the City with the street oversizing fund as available. I will certainly be happy to meet with The Group, at your earliest convenience, to review these issues. Box 580 Fort Collins, CO 80522 Dear Steve, The Group, Inc. has begun preliminary design and planning of the 30 acre parcel known as the Platt Property located at Seneca and Wakerobin. The site is adjacent to the new Johnson and Webber schools. Our planning of this site will initiate renewed development interest in this area. The development requirements of the site are complicated by lingering disagreements and pending new agreements between the City and the School District. In our effort to stimulate residential development west of Shields, we hope that we can facilitate resolution of the issues which could stymie development in the area. There seems to be considerable confusion regarding the need for street improvements and the repay obligations for streets previously constructed. Further, the need to extend Troutman Parkway west of Shields seems to fall disproportionately on our small site. The schools will be significant generators of traffic, and at the completion of Webber Junior High, the construction of Troutman will be warranted irrespective of the development of 80 to 90 lots on the Platt property. It is our understanding that agreements were made by the District and the City or Craig Platt (original land owner) for construction of Troutman. Craig Platt claims that he actually "gave" Poudre R-1 its second school site in return for the. District installing these streets and not filing repays against his remaining 30 acres which we have under contract. Realtors Page 2 January 18, 1990 It now appears that since development of the 30 acres is imminent, there is an effort to: A) File repays on the 30 acres long after the deadline B) A repay to Home Federal for over $8,000.00 was an unpleasant surprise, which was not mentioned at all the the City staff in our earlier meeting. C) Force the developer of this 30 acre parcel to install one- third of a mile of a collector sheet even though only a small portion of the developers property touches Troutman Parkway . and the need for Troutman is being generated in fact primarily by the schools. Perhaps our greatest frustration in all of this is our inability to get the School District, the City, and ourselves into a room together to work through this political "hot potato". We are asking for your help in bringing this group together. we are willing to help. We perceive that our involvement will offer the City and District a "window of opportunity" for us to help pay for these improvements. Specifically: A) We are willing to pay a reasonable amount for payback.s on existing streets though we are not willing to pay $93,000.00. B) We are willing to pay our share of Troutman, though we are not willing to bear the entire upfront cost of Troutman. Realtors Page 3 January 18, 1990 If the City, the District and The Group, Inc. are unable to seek a satisfactory resolution, we will be forced to walk from our contract and a "window of opportunity" will have been missed. •pie seriously doubt that another developer can be found in a reasonable time frame who would be willing to acquire this property once he learns he will be required to make street improvements at a disproportionate cost to the value of the land and future development. It is our goal to be cooperative and help the City and The District address the long-term street needs. Closer communication is the logical starting point. I'd like to request a meeting with you to investigate ways we can work together to see that this area develops in an efficient pattern with adequate and reasonable public services.
