1. Staff has assessed further the recommended land uses for future zoning of the site and to assure
consistency with the East Mulberry Corridor Plan. The Neighborhood Commercial (N C) designation
included in the EMCP split on both sides of Greenfields Drive needs to be part of recommended future
zoning (please see Planning redline to replace eastern portion of Employment designation on conceptual
map with NC fronting Greenfields). With this revision to include NC, please revise list of future zoning in
petition, zoning legals and project description to reflect five zones on properties.
Response: The application has been revised to now include Neighborhood Commercial as
requested.
Please provide updated land use concept plan that shows general size in acres for each of the 5 land uses
for comparison with EMCP. This will help staff for presenting anticipated zoning areas.
Response: A revised zoning concept map has been included as part of this resubmittal.
The submitted zoning map is not part of application for approval of annexation. This may be useful after
approval for GIS to assess future zoning areas.

2. COUNCIL DECISION ON SCHEDULE OF THIS ITEM.
City Council needs to find that certain quasi judicial matters are pressing and require prompt action and that
virtual technology will provide due process to hear them through sufficient public participation and input, and
based upon such findings authorize Quasi Judicial Hearings using Remote Technology by the Planning &
Zoning Board, the Landmark Preservation Commission, the Building Review Board and City Council. Staff is
preparing a request for Council and Planning and Zoning Board to hear this item.

1. Annexations alone do not generate traffic or trips, thus no traffic evaluation is required with this submittal.
However, any future proposed development of this property will still be subject to a traffic evaluation,
depending on scope of that project.

1. A portion of this property is currently located in the FEMA regulated, 100 year Cooper Slough floodplain and
if annexed into the City must comply with the safety regulations of Chapter 10 of City Municipal Code. A
FEMA Flood Risk map is attached.

2. Any construction activities in the floodplain (e.g. grading, structures, sidewalk or curb & gutter
installation/replacement, utility work, landscaping, etc.) must be preceded by an approved floodplain use
permit, the appropriate permit application fees, and approved plans.

3. Please note that in the City of Fort Collins Construction of residential and nonresidential structures is
allowed in the Cooper Slough 100 year floodplain, as long as the lowest finished floor of the building, and all
duct work, heating, ventilation, electrical systems, etc. are elevated 18 inches above the Base Flood
Elevation (BFE). This elevation is known as the Regulatory Flood Protection Elevation (RFPE). RFPE =
BFE + 18 inches. No basements are allowed in the 100 year floodplain. An approved FEMA Elevation
Certificate, completed by a licensed surveyor or civil engineer and showing that the addition is constructed
to the required elevation, is required prior to a Certificate of Occupancy (CO) being issued.

4. Critical facilities as defined in Chapter 10 of City Code, are prohibited in the 100 year floodplain. Critical
facilities include essential services facilities, hazardous materials facilities, at risk population facilities, and
government services facilities.

pursued.
5. Change of Use of any structure or property or any portion thereof, located in the flood fringe, which would
result in a use or expansion of a use inconsistent with the requirements of Chapter 10 is prohibited.

6. If a nonconforming structure is abandoned for 12 consecutive months, the structure must be brought into
compliance per Chapter 10 prior to any future use.

- Driveway culverts and borrow ditches (roadside ditches) may require maintenance or

- Existing infrastructure needs to be inspected and may require maintenance, repair, and/or
replacement if it is undersized or does not meet City standards.

1. This property is currently within PVREA service area. Once annexed into the City, Light and Power does
have the right to serve the property, but currently our facilities are far away from the property and will require
capital funding to get to the proposed annexation. Please coordinate with Light and Power on timing to see
if this property can be served by City Light and Power at the time of development.

1. 09/21/2020: AT TIME OF PROJECT DEVELOPMENT PROPOSAL:
There are no Environmental Planning comments to address for the annexation however when this property
is proposed for development there will be environmental requirements. The City views irrigation canals as
wildlife corridors and the site is bounded by Lake Canal to the south. Mitigation will be required. Standard
mitigation is a 50 foot buffer from the canal's top of bank. There is flexibility within the code that allows the
buffer to be reduced or expanded provided the development meets the performance standards outlined in
the code. Modifying the standard buffer distance would require close consultation with Environmental
Planning staff for approval.
Response: Comment noted. The Applicant will review and address environmental at the appropriate
time.
09/21/2020: AT PDP
When a Project Development Plan (PDP) is submitted to the city, an Ecological Characterization Study
(ECS) will be required 10 days prior to submitting the PDP documents. The ECS should be performed by a
qualified third party natural resources specialist and address all items in 3.4.1(D)(1)(a) (l) of the Land Use
Code (available for view online). In addition, ensure that the study identifies feature(s) size, the "top of bank"
of the ditch, the edge(s) of wetlands, and whether jurisdictional wetlands may be impacted by the proposed
project.
Response: The ECS will prepared and provided at the required time.

A lighting plan will be required as part of the development plans. Note, no light spillage can occur within any
environmental buffer.

1. 10/08/2020: FOR HEARING:
Lake Canal Company of Colorado would like to make sure our easement is properly addressed on any
plans going forward, to note that our current access road along the ditch must remain in place and
unobstructed and any crossing of the ditch for utilities, etc. will require a crossing agreement with the
Company.
Response: The easement is shown on all plans and will be addressed during future development
applications, as appropriate.
Larimer County
1. There was some discussion regarding future extensions of Donella Ct and Delozier Dr to the west of this
annexation. For specifics, please contact Don Threewitt, Planning Manager for Larimer County Community
Development, 970-498-7689. Also, the County would like the City to annex all of the Frontage Rd along the
southern boundary of this annexation.
Response: As development moves forward these connections will be considered, and we will work
with the County as that design progresses. Additionally, the frontage road, outside of CDOT ROW
has been included within this revised application.
