PROJECT DESCRIPTION:
This is a request to annex and zone 5.3 acres located at 625 East Harmony
Road, approximately 200 feet west of Boardwalk Drive. The property is
occupied by the Front Range Baptist Church. Present uses include a church,
private school, and open space. The requested zoning is R-L-P, Low Density
Planned Residential.
RECOMMENDATION:
Staff recommends approval of the annexation and zoning.
EXECUTIVE SUMMARY:
This is a request to annex and zone the Front Range Baptist Church, located
on the south side of Harmony Road, approximately 200 feet west of Boardwalk
Drive. The site consists of 5.3 acres. The petitioners request to be zoned
R-L-P, Low Density Planned Residential. The existing uses (church, private
school, open space) are allowed by right in the R-L-P zone. The requested
zoning does not contain a condition that all development proceed as a Planned
Unit Development. Uses allowed by right in the R-L-P zone would not be
subject to P.U.D. review. Any land use not allowed by right in the R-L-P zone
would be subject to the P.U.D. review process as described in the Land
Development Guidance System. The annexation request is 100% voluntary.
The minimum one -sixth contiguity requirement is satisfied by the shared
easterly and southerly property lines with the Keentand Annexation.

COMMENTS
Background:
The surrounding zoning and land uses are as follows:
N: R-L-P; 7-Eleven Convenience Store and Vacant
S: R-P; Vacant (Oak -Cottonwood Farm Master Plan, Parcel 1G - single family)
E: R-P; Vacant (Oak -Cottonwood Farm Master Plan, Parcel IA - retail/office)
W: FA; (County) single family homes (Fairway Estates)
The subject property is currently zoned FA-1, Farming District, and is
presently developed. Improvements include a church, private school, parking
lot, and open space. The 5.3 acres is predominantly owned by the Front Range
Baptist Church. Oak Farm, Inc. owns a strip along the southerly boundary line
of the annexation.
Any existing commercial signs on the property will have to conform to the
City's Sign Code at the conclusion of a five year amortization period.
There are no immediate development plans for the property.
The property is located within the Fort Collins Urban Growth Area.
According to policies and agreements between the City of Fort Collins and
Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR
THE FORT COLLINS URBAN GROWTH AREA, the City will annex property
in the U.G.A. when the property is eligible for annexation according to State
law. The property gains the required one -sixth contiguity to existing city
limits from a common boundary with the Keenland Annexation to the east and
south.
The R-L-P, Low Density Planned Residential, zone district is for areas planned
as a unit to provide variation in use, density, and building placement.
According to the City's Land Use Policies Plan, low density residential uses
should locate in areas which have easy access to existing or planned
neighborhood and regional/community shopping centers; in areas which have
easy access to major employment centers; within walking distance of an
elementary school; within walking distance of an existing or proposed
neighborhood park; and where a collector street affords the primary access.
The site addresses these locational criteria.
2. Findings:
A. The annexation of this property is consistent with the policies and
agreements between Larimer County and the City of Fort Collins
contained in the INTERGOVERNMENTAL AGREEMENT FOR THE
FORT COLLINS URBAN GROWTH AREA.
B. The property meets all criteria included in State law to qualify for a
voluntary annexation to the City of Fort Collins.

C. On February 20, 1990, the City Council approved a resolution which
accepts the annexation petition and determines that the petition is in
compliance with State law. The resolution also initiates the annexation
process for this property by establishing the date, time and place when a
public hearing will be held regarding the readings of the Ordinances
annexing and zoning the property. Public hearing and second reading of
the Ordinances annexing and zoning the property will be considered by
the City Council on April 17, 1990.
D. The requested R-L-P Low Density Planned Residential district is in
conformance with the policies of the City's Comprehensive Plan.
RECOMMENDATION
Staff recommends approval of the annexation and requested zoning.

PETITION FOR ANNEXATION
The undersigned hereby petition the Council of the City of Fort Collins,
Colorado, for the annexation of an area, to be referred to as the
FRONT RANGE BAPTIST CHURCH Annexation to the City of Fort
Collins. Said area, consisting of approximately 5x3 acres, is more
particularly described on Attachment "A", attached hereto.
The petitioners allege:
L That it is desirable and necessary that such area be annexed to the
City of Fort Collins.
2. That the requirements of Sections 31-12-104 and '31-12-105, C.R.S., exist
or have been met.
3. That not less than one -sixth of the perimeter of the area proposed to
be annexed is contiguous with the boundaries of the City of Fort
Collins.
4. That a community of interest exists between the area proposed to be
annexed and the City of Fort Collins.
5: That the area to be annexed is urban or will be urbanized in the
near future.
6. That the area proposed to be annexed is integrated with or capable of
being integrated with the City of Fort Collins.
7. That the petitioners herein comprise more than fifty percent (50%) of
the landowners in the area and own more than fifty percent (50%) of
the area to be annexed, excluding public streets, alleys and lands
owned by the City of Fort Collins.
8. That the City of Fort Collins shall not be required to assume any
obligation respecting the construction of water mains, sewer lines, gas
mains, electric service lines, streets or any other services or utilities
in connection with the property proposed to be annexed except as
may be provided by the ordinances of the City of Fort Collins.
Further, the petitioners consent pursuant to Section 37-45-136(3.6), C.R.S,,
to the inclusion of such property into the Municipal Subdistrictj Northern
Colorado Water Conservancy District.
WHEREFORE, said petitioners request that the Council of the City of
Fort Collins approve the annexation of said area. Furthermore, the petitioners
request that said area be placed in the R — L P Zoning District
pursuant to Chapter 29 (Zoning) of the Code of the City of Fort Collins.
