HomeMy WebLinkAboutPADIA MINOR SUBDIVISION - 55 92 - CORRESPONDENCE - TRANSPORTATION ISSUECity of Fort Collins November- 12, 1992 Mr. Brian Shear - Shear Engineering 4836 South College Avenue Fort Collins, CO 80525 RE: Padia Minor Subdivision Dear Brian: The Planning Department has recently become aware of an issue regarding legal access to the proposed Lot 1 of the Padia Subdivision. The City Surveying Department has reason to believe that, as proposed, there is no contiguous legal access to the public street system from Lot 1 due to the Union Pacific Railroad right-of-way. In order to make the connection from Hemlock Street to Fourth Street, (the street that serves the proposed lot) there is a crossing of railroad right-of-way for approximately 340 feet. There is some doubt as to whether the crossing of this railroad right-of-way is a trespass or if an easement has been granted by Union Pacific for access. The Planning Department is hesitant to recommend approval for the proposed plat unless it can be demonstrated that crossing the railroad right-of-way is not a trespass. You are encouraged to ask the. County Parks Department about this issue since access to the McMurry Natural Area is also via this same route. one option would be to plat the legal access to the proposed lot north to Hickory Street rather than south to Fourth Street and Hemlock Street. Access to the north not only solves the problem with the railroad right-of-way, but also satisfies the concerns of the Poudre Fire Authority. Please be aware that access to Hickory would require right-of-way dedication of 37.8 feet for additional width along the lot's frontage.
