Box 580 Fort Collins, CO 80522 Dear Board Members; Cho o urban design, inc. 3030 south college ave., suite 200 fort collins, colorado 80525 (303) 226-4074 In May of 1990, a petition for annexation of the Burns Ranch was submitted to the City of Fort Collins with the agreement that the Second Reading of the Annexation and Zoning Ordinances would be scheduled for City Council action after the Planning and Zoning Board's public hearing on the Preliminary Cluster Plan. The Annexation was approved on First Reading on that basis. Because existing plans approved for the site could become "nonconforming" — and because of the extensive open space requirements of the RF zone — the applicant may not wish to complete annexation if a well designed cluster plan, meeting all requirements of the RF Zone, cannot gain City approval. The Planning and Zoning Board Public Hearing for the Preliminary Plat and Cluster Plan was therefore scheduled for December 17th, and Second Reading of the Annexation and Zoning Ordinances for January 15th. This week, however, the City Attorney decided that the Planning and Zoning Board may not give even Preliminary approval to a plan for property not yet annexed. In light of this late change in the rules, we are requesting that the Planning and Zoning Board review the proposed Cluster Plan, and allow public comment as scheduled at your December 17th meeting, but not vote on the item until your January 28th meeting. Staff review of the Preliminary Plat and Cluster Plans is complete, and no changes in the plans are anticipated between December 17th and January 28th. Final engineering design of streets, drainage improvements, and utilities will — as always — be completed with Final Plats in the future. Thank you for your consideration of this item.
