Paul Eckman, Degaty City Attorney RE: Burns Annexation Attached please find a letter dated January 30, 1991, from Jim Martell to me regarding the Burns Annexation Also attached is a "Domestic Water Supply Plan" prepared by Rex Burns as a proposal for the supply of domestic water to the Burns Annexation. I have not yet reviewed the Domestic Water'Supply Plan of Mr. Burns but thought I ought to also forward it to both of you for your review and comment. Please advise. Mrs. Burns and the members of her family are the owners of .a parcel of property located in Larimer.County, Colorado, south of brake Road and west of Overland Trail extended. The Burns family has petitioned the City of Fort Collins to annex the property. The Burns family has also submitted a cluster plan for Burns Ranch at Quail Ridge. At the present time, the second reading regarding the. Burns annexation is presently scheduled for the February 19, 1991F City Council meeting. The cluster plan for Burns Ranch at Quail Ridge is scheduled for final consideration by the Planning and Zoning Board on February 25, 1991. One of the issues raised by the development of the Burns property is the provision of domestic water to the Burns property and other properties located to the west of Overland Trail extended. Ruth Burns' son, Rex Burns, is a professional engineer. Mr. Burns has prepared a Domestic Water Supply Plan for the Foothills Service Zone. Enclosed please find a copy of the Domestic Water Supply Plan prepared by Rex Burns. I believe Mr. Burns has discussed the plan with the appropriate officers of the Fort Collins/Loveland Water District and with Michael Smith of the City of Fort Collins Utility Department. Rex Burns has requested that I forward the document to you for your review: In reviewing the Domestic Water Supply Plan prepared by Rex Burns, you will note that the plan includes a proposal -for funding the costs of the operation and maintenance of the water supply system through a general improvement district. I have preliminiarily investigated the possiblity of forming a general. improvement district to pay the costs of the operation and maintenance of the water supply system. The general improvement district appears to be feasible as a mechanism for funding the costs of operation and maintenance of the water supply system.. After you have had an opportunity to review the Domestic Water Supply Plan, please call me if you should have questions.
