Enclosed please find a.copy of the noise level survey
Which I requested from the Larimer County Department of
Environmental Health..
A few words of explanation: I was informed as to the
date and approximate time of the survey: Therefore, I was
able to invite children from `other daycare homes.to.j'oin us..
In this way,•I was able to closely approximate the, number
of children"which would be on site at any time:l This number
includes my own three school -:aged children, which were all .
present in the play yard. Additionally, I planned activities
which typically excite the children.and.get them quite wound
up. In other words, I attempted to stage a situation with
the maximum number of people and the'maximum,amount of noise.
Additional activity not mentioned in the report; but
which occurred during the noise survey includedltwo Parents
entering the play yard to pick up their children and one
child,crying when pushed by another child.
The report summary explains that the cars on Swallow
drowned out any noise made by the children. Without traffic,
the sounds of children playing never exceeded 5'S dB, the sound
level of two people engaged,in normal conversation.

NOISE SURVEY AT WONDERLAND DAY CARE AND PRESCHOOL
A noise survey was conducted May 31, 1990 at Wonderland Day Care and Preschool
located at 3018 Calvary Court, Fort Collins, Colorado. At the time of the survey
there were 15 children playing in the backyard. The age range was 1j years old to
17 years old, with 10 children between 1j and 5 years old and 5 school age (two 7
year olds, one 8 year old, one 12 year old and one 17 year old).
Activities taking place during the noise survey included group play activities
that excited the children such as chasing bubbles, bouncing balls in the center of
a large parachute, playing in the sand box and on the playgroundlequipment.
Children were laughing and running around.
At site #1, I was directly behind the house approximately 20 feet from the
chain link fence.
Kids playing 45-55 dB(A)
Traffic on West Swallow 50 to 60 dB(A)
Site #2 - West side of ditch, behind house on Meadowlark Drive (Third house
north of West Swallow on Meadowlark Drive)
Traffic on West Swallow 46 to 52 dB(A)
Children playing 45* to 50 dB(A)
* Meter does not measure noise levels below 45 dB, so
reading may have been lower than that.
Background noises which I could hear, but did not register on noise meter
included train, dogs barking, birds in trees along the ditch and wind blowing
leaves in the trees.
Summary
Based on the city noise ordinance of 55 dB(A) from 7 a.m. to 7 p.m. my
preliminary noise survey did not find any noise violations. The cars going by on
West. Swallow were louder than the children playing. In fact, Thad to wait for a
break in traffic to get a noise meter reading of the children playing.
The noise survey was conducted under what would be the maximum children
present and engaged in active and. boisterous play. Ms. Jacobs indicated a privacy
fence was going to be put up along the back, this would further reduce the noise.

§ 78-1. Unreasonable noise prohibited.
It shall be unlawful for any.person to make, continue or cause to•be
made or continued any unreasonable noise in the City of Fort Collins.
For purposes of this section, members of the Police Department a*
empowered to make a prima facie determination as to whether a
noise is unreasonable. [Amended 8-6-85 by O d. No-70,-I985]
§ 78.2. Maximum, permissible noise levels:
A. A -noise measured or registered in the manner provided in
§ 78-3 from any source at a level which is in excess of the
dB(A) established for the time period and land uses listed
in this section is hereby declared to be excessive and
unusually loud.and ismnlawful. When a noisesourcecan be

B. _Between the hours of 7.00 a.m. and 7i00 p.m., the noise
levels _permitted :in Subsection A may be increased
by ten
(10) decibels for a period of not to exceed fifteen (15)
minutes in any one -hour period.
§ 78.3. Classification and measurement of noise.
For the ,purposes of determirring and classifying any noise as
excessive"or unusually loud and,. as such, in violation of § 78.2 of
this chapter, the following test measurements and requirements
may be:applied; provided, however, that a violation of § 78.1 may
occur without the following measurements being made:

A. Noise occurring within the jurisdiction of the City of Fort
Collins shall be measured. at a distance of at least twenty-
five (25) feet from a noise source located within the public.
right-of-way, and, if'the noise source is located on private
property or public property other than the .public right-of-
way, the noise -shall be measured at or within the property
boundary of the receiving land use.
B. The noise shall be measured on a weighing scale,on a sound
level meter of standard design and quality and in ac-
cordance with the standardspromulgated with the
American National Standards Institute.
C. For the purposes of this ordinance, measurements w10
sound level meters shall be. made when a wind velocity at
thetime?and place ofsuch measure:is not.more than five (5)
miles per hour or twenty-five (25) miles per hour with a
windscreen appropriately attached to the microphone.
§ 78-4. Exceptions.
A. The provisions of this chapter shall not apply to:
(1) Any noise resulting from any authorized emergency
vehicle in responding to an emergency call or acting in
time of emergency.
(2) The unamplified;'human voice.
(3) The operation of aircraft or other activities which are
subject to federal law with respect to noise contr
B. Notwithstanding any other provision of the chapt ,
construction or demolition -projects -shall be_subject: to the
maximum permissible noise levels specified for industrial
uses zoned I-G for the period within which construction or
demolition is to be completed pursuant to :any applicable
permit issued by the City of Fort Collins or, if no time
limitation is imposed, for a reasonable period of time for
completion of the construction or demolition project. This
section shall not preclude obtaining, a variance for a
construction or demolition project" pursuant to § 78-5.

C. Nothing in this • chapter shall preclude any type of
emergency activity necessary for the protection of the
health, safety and welfare of the citizens of the -City of Fort
Collins.
§ 785. Variances.
A. The City Manager or his duly authorized representatives
shall havethe authority to grant:special variances from the
provisions of this chapter. Any person seeking a special
variance shall file an application with the appropriate
official. The application shall contain the date, time,
location and duration of activity for which the variance is
requested as well as information which demonstrates that
bringing the source of sound or activity for which the
special variance is sought into compliance with this
chapter would constitute an unreasonable hardship on the
applicant, on the community or on other persons.
B. In determining whether to grant or deny the application,
the appropriate official shall balance the hardships to the
applicant: of not granting the special variance against the
adverse impact on the health, safety and welfare of persons
-affected, the adverse impact on property affected and any
other adverse impacts of granting the special variance.
Special variance decisions may be appealed to the Council
of the City of Fort Collins. Special variances shall be
granted by notice to the•applicantcontaining all necessary
conditions, including a time limit on the permitted activity.
C. Under no circumstances shall the noise level of an activity
_for which a special variance is granted for a period of time
in excess,of eight(8) hours exceed ninety (90) decibels.
D. Noncompliance with any condition of the special variance
permit shall terminate the permit and subject the person
holding it to compliance with the provisions of this chapter
regulating maximum permissible, noise levels.
§ 78.6. Quiet zones.
The City Council shall have the authority to designate, 'by
resolution, certain areas as quiet zones.

A. Said quiet zones may include but are not limited to the
following:
11) Schools. .
12) Hospitals:
(3) Nursing homes.
(4) Convalescent homes.
(5) Places of worship.
(6) Courts.
B. 'In any area so designated, the sound level shall at no 4
exceed the maximum sound levelestablished for residential
uses under § 78-2 of this chapter.
§ 78.7. Motor vehicle maximum sound levels.
A. Motor vehicles and motorcycles on public rights -of -way.
No person shall operate or cause to be operated a public or
} private motor vehicle or motorcycle on a public right-of-
way at any time in such a manner that the sound level'
emitted by the motor vehicle or motorcycle exceeds the
levels set forth below:

B. Motor vehicle horns and signaling devices. The sounding
of any horn or other auditory signaling device on or in. any
motor vehicle on any public right-of-way or public space,
except as a warning of danger, is declared to be in violation
of this chapter.
C. Motorized vehicles operating off public rights -of -way. No
person shall operate or cause to be operated any motor
vehicle or motorcycle off a public rightof-way in :such a
manner that the sound level emitted exceeds, the limits set
forth in § 78.2. This: section shall apply to all motor
vehicles, whether or not duly licensed and registered,
including but not limited to commercial or noncommercial
racing vehicles, motorcycles, go-carts, snowmobiles,
.amphibious crafts,-campers.-and-dune-buggies-
D. Noise Measurement. Noise shall be measured at a distance
of at,least twenty-five (25) feet from the near side of the
nearest lane being monitored and at a height of at least
four (4) feet above the immediate surrounding surface.
§ 78.8. Violations and ,penalties; severability..
A. Penalties. Any person who violates any provision of this
chapter shall be subject to a fine not to exceed' three

hundred dollars ($300.) or imprisonment not to exceed
ninety (90) days, or a combination of both, fine and im-
prisonment.
B. Notice of violation. Violation of any provision of this
chapter shall be cause fora summons to be issued by
authorized enforcement officials according to adopted
procedures.
C. Severability. If -any provision of this chapter is held to be
unconstitutional or otherwise invalid by any court of
competent jurisdiction, the remaining provisions of the
chapter shall not be invalidated.
§ 78.9. Definitions.
As used in this chapter, the following terms shall have the
meanings indicated:
A -WEIGHTED SOUND LEVEL — The sound pressure
level in decibels as measured on a sound level meter using
the A -weighing; network. The level so read is designated
dB(A) or dBA.
CONSTRUCTION — Any site preparation, assembly,
erection, substantial repair, alteration or similar action,
but excluding demolition,for or of public or private rights-
of -way, structures, utilities or similar property.
CYCLICALLY VARYING NOISE — Steady or fluc-
tuating noise which varies in amplitude such that the s
sound pressure- level is obtained repetitively at unifol&
intervals of time. _
DECIBEL — A unit for measuring the volume of sound;
equal to twenty (20) times the logarithm to the base 10 of
the,ratio of the pressure of the sound measurement to the
reference pressure, which is twenty (20) micropascals
[twenty (20) micronewtons per -square meter].
DEMOLITION — Any dismantling, intentional
destruction or removal of structures, utilities, public or
private rights -of -way, surfaces or similar properties.

EMERGENCY — Any occurrence or set of circumstances
involving actual or imminent physical trauma or property
damage which demands immediate action.
EMERGENCY WORK Any work performed for the
purpose of protecting persons or property from imminent
exposure to danger or restoring property to a safe con-
dition.
GROSS VEHICLE WEIGHT RATING (GVWR) — The
value specified by the manufacturer as the recommended
maximum loaded weighttof a,single motor vehicle. In cases
where trailers and tractors are separable, the ,gross com-
bination weight rating (GCWR.), which is the value
specified by the manufacturer as the recommended
maximum loaded weight of the combination vehicle, shall
be used:
IMPULSIVE SOUND — A noise containing excursions
usually less than one (1) second of sound pressure level
twenty 120) dB1A) over the ambient noise level using the
fast meter characteristic.
INTERMITTENT NOISE — A noise whose sound
pressure level equals or is less than the ambient noise level
two (2) or more times during the period of observation and
is greater than the ambient during the remainder of the
period
MOTORCYCLES — An unenclosed motonvehicle having
a saddle for the use of the operator and two (2) or three (3)
wheels in contact with the ground, including but not
limited to motor scooters and minibikes.
MOTOR VEHICLE — Any vehicle which'is• propelled or
drawn onland. by a motor, such as but not limited to
passenger cars, trucks, truck -trailers, semitrailers, camp- J�
ers, go-carts, snowmobiles, amphibious craft on land, dune
buggies or racing vehicles, but not including motorcycles.
NOISE — Any sound which annoys or disturbs humans or
which causes or tends to cause an adverse psychological or .
physiological effect on humans.

NOISE DISTURBANCE - Any sound which endangers
or 'injures the safety or health of humans or animals or
annoys or disturbs a reasonable person of normal sen-
sitivities or endangers or injures personal or real property."
PERSON — Any individual, association, partnership or
corporation, and includes any officer, employee, depart•
meat;: agency or instrumentality of a state or any political
subdivision of a state.
PROPERTY BOUNDARY — An imaginary line along the
ground surface and its vertical extension, which separates
the real property owned by one (1) person from that own
by another person; but not including intrabuilding rdW
property divisions.
PUBLIC RIGHT-OF-WAY — Any street, avenue,
boulevard, highway, sidewalk or alley or similar place
which is owned or controlled bya governmental entity.
PUBLIC SPACE — Any real property or structures
thereon which are owned or controlled by a governmental
entity.
QUIET ZONE — Any area for the purpose of ensuring
exceptional quiet.
SOUND — An oscillation in pressure, particle
-displacement, particle velocity or any other physical
parameter 'in a medium with internal forces that causes
compression and rarefaction of that medium. The
description of sound may include any characteristic of sub
sound; including duration, .intensity and frequency.
SOUND LEVEL — The weighted sound pressure level
obtained by the -use of the sound level meter and -frequency
weighting network, as -specified in the American National
Standards Institute specifications.
SOUND .LEVEL METER — An instrument which in-
cludes •a microphone, amplifier, root -mean -square detector,
integrator or time averages, output meter and weighting
networks used to measure sound pressure levels.
