RE: Overland Hills First and Second Filings
Dear Kim:
Per our telephone conversation on Monday, I am documenting the
remaining items to be resolved to proceed with recording the final
documents for the First Filing and the items we discussed
pertaining to the Second Filing.
The following items are required to complete the City's review and
approval of Overland Hills First Filing:
1. Signed development agreement - including both your signature
and all City signatures. A draft agreement has been faxed on
April 2, 1992 for your review and comment. Please call me
with any questions at 303-221-6750. When you are ready to
sign the agreement, I will mail the original and 3 copies for
your signature and you will then return all 4 to our office
for City signatures.
2. Off -site drainage easements or recording of the Second Filing
plat - as I have explained to you, in order to file the plat
for the 2nd Filing and thus dedicate off -site drainage
easements for the 1st Filing by plat, the development
agreement for the 2nd Filing would need to be signed. We
agreed that there are some issues on the 2nd Filing that may
take some time to resolve to the point where you are ready to
sign a development agreement and as a result may delay
recording of the 2nd Filing plat. Therefore, you have the
option to dedicate the off -site easements for the 1st Filing
by separate document (deed). We will need to have the signed,
attorney certified, deeds,in a form acceptable to the City, in
hand prior to signing final utility plans.
3. Final Utility Plans - your engineer will need to submit final
mylars for City approval after obtaining approval from the
Fort Collins -Loveland Water District. The City Stormwater
Utility will not approve plans until the off -site drainage
easements have been dedicated and the final drainage report
has been submitted and approved.

4. Construction easement/permission from adjacent property owner
- the City Engineering Department has asked that either a
construction easement or a letter of permission be obtained
from the adjacent property owner for the construction of
Platte Place and Platte Court. If this permission is not
obtained, your engineer will need to verify and provide proof
(construction details) that all construction can take place on
your property without trespassing in any way on the adjacent
property owner's land. Mike Herzig of the Engineering
Department will need to accept and approve of the solution
prior to signing of the final utility plans.
5. Final Plat - the final plat will be recorded when the
development agreement has been executed, however construction
cannot begin until final utility plans are approved subject to
the conditions discussed above.
The following items are required to complete the City's review of
the overland Hills Second Filing:
1. Development Agreement - Mike Herzig and I will be preparing a
draft agreement for your review. Due to our heavy workload at
this time, some projects currently up for Planning and Zoning
Board approval have priority, but we will be getting you a
draft as soon as possible. As you are aware, Horsetooth Road
needs to be improved off -site to the east along the
Springfield Subdivision. Mike Herzig and I have both
discussed this issue with Jim Gefroh. At this point, I do not
believe the issue has been resolved to Jim's satisfaction, and
further discussions will need to take place. Also, if a repay
agreement becomes part of the process, additional time will be
needed to draft and execute that agreement in addition to the
Development Agreement.
r/ Also, the agreement will address the obligation for Horsetooth
improvements along Lot 1 to the west property line and other
street improvement obligations being attached to Parcel "C"
including overland Trail, Horsetooth Road, and the culvert
crossing over Spring Creek on Horsetooth Road.
2. Final Utility Plans - Again, your engineer will need to submit
mylars and a final drainage report for approval. The utility
plans must be revised to show the drainage facilities for the
1st Filing and notes regarding maintenance must be added to
the grading and drainage plan. In addition, the Development
Agreement will contain language to define the obligation for
maintenance of all drainage improvements.
3. Final Plat - The plat for the 2nd Filing needs to be revised
to show any easements that are dedicated by separate document
as well as all other easements and rights -of -way dedicated
with the 2nd Filing. The plat will also need to have notes
regarding maintenance of the drainage facilities, particularly
those related to the 1st Filing, so it is clear to owners of

Lots 3 and 4 that they are responsible for maintenance of
those facilities.
