Resolution 91- 76 Initiating Annexation Proceedings for the Burlington Northern
Southeast First Annexation.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The property being considered for annexation and the adjacent properties which
comprise the concurrent East Lincoln Second Annexation, have, for a period of
not less than three (3) years, been completely surrounded by property contained
within the boundaries of the City of Fort Collins. The Burlington Northern
property being considered for annexation is approximately 18.35 acres in size
and is located north of East Prospect Road, south of East Mulberry Road and east
of Riverside Drive. The property consists of the Burlington Northern Railroad
right-of-way.
The proposed Resolution makes findings that the annexation substantially complies
with the Municipal Annexation Act. The Resolution also determines that a public
hearing should be established regarding the annexation and zoning, and directs
that notice be given of the hearing. The hearing will be held at the time of
first reading of the annexation and zoning ordinances. Not less than thirty days
of prior notice is required by Cclorado law.
The property is located within the Fort Collins Urban Growth Area. According
to policies and agreements between the City of Fort Collins and Larimer County
contained in the Intergovernmental Agreement for the Fort Collins Urban Growth
Area, the City will agree to consider the annexation of property in the UGA when
the property is eligible for annexation according to state law. The property
became completely surrounded by the City of Fort Collins through the following
annexations:

Planning and Zoning Board Recommendation:
The Planning and Zoning Board will conduct a public hearing on the proposed
annexation and zoning at its regular monthly meeting on May 20, 1991, and will
make a recommendation at that time. The Board's recommendation will be forwarded
to the City Council in time for public hearing and first readings of the
annexation and zoning ordinances.

OF THE COUNCIL OF THE CITY OF.FORT COLLINS
STATING THE INTENT OF THE CITY OF FORT COLLINS
TO ANNEX CERTAIN PROPERTY AND
INITIATING ANNEXATION PROCEEDINGS FOR SUCH PROPERTY
TO BE KNOWN AS THE BURLINGTON NORTHERN SOUTHEAST
FIRST ANNEXATION
WHEREAS, the property hereinafter described has, for a period of not less
than three (3) years prior to this date, been completely contained within the
boundaries of the City of Fort Collins; and
WHEREAS, the Council desires to initiate annexation proceedings in
accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That, the Council of the City of Fort Collins intends to annex
the following described property, to be known as the Burlington Northern
Southeast First Annexation, situate in the County of Larimer, State of Colorado,
to wit:
A tract of land situate in Sections 12 and 13, Township 7 North,
Range 69 West and Section 18, Township 7 North Range 68 West of the
6th P.M., Larimer County, Colorado, which considering the South line
of the Southeast Quarter of said Section 18 as bearing S 88°47'08"
W, and with all bearings contained herein relative thereto is
contained within the boundary lines which begin at the Southeast
corner of said Section 18 and runs thence S 88°47'08" W 436.06 feet
along the South line of Section 18 to the true point of beginning,
being a point on the Easterly ROW line of the Burlington Northern
Railroad; thence S 88°47'08" W 106.42 feet; thence along the arc of
a 2914.93 foot radius curve to the left a distance of 37.98 feet,
the long chord of which bears N 20°29'27" W 37.98 feet; thence along
a spiral out with a length of 151.31 feet and a delta of 1°30'00"
the long chord of which bears N 19°07'11" W 151.30 feet; thence N
18037'03" W 1320.10 feet; thence along a spiral in with a length of
147.00 feet and a delta of 3°00'00", the long chord of which bears
N 19°36'31" W 147.36 feet; thence along the arc of a 1382.69 foot
radius curve to the left a distance of 1101.25 feet, the long chord

with a length of 147.00 feet and a delta of 3°00'00", the long chord

a distance of 2496.77 feet, the long chord of which bears N

point on the West line of the Southeast Quarter of said Section 12;

Section 2. That the Council hereby initiates annexation proceedings for
the above -described property.
Section 3. That the Notice attached hereto be adopted as a part of this
Resolution. Said Notice establishes the date, time and place when a hearing
will be held regarding the passage of an annexation ordinance pertaining to the
above described property. The City Clerk is directed to publish a copy of this
Resolution and said Notice as provided in Section 31-12-108(2), C.R.S.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 21st day of May, A.D. 1991.

TO ALL PERSONS INTERESTED:
PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has
adopted a Resolution initiating annexation proceedings for the Burlington
Northern Southeast First Annexation, said Annexation being more particularly
described in said Resolution, a copy of which precedes this Notice.
That, on July 2, 1991, at the hour of 6:30 p.m., or as soon thereafter as
the matter may come on for hearing in the Council Chambers in the City Hall, 300
Laporte Avenue, Fort Collins, Colorado, the Fort CoTlins City Council will hold
a hearing for the purpose of finding and determining whether the property
proposed to be annexed meets the applicable requirements of Colorado law and is
considered eligible for annexation.
