I am in receipt of your letter dated December 18, 1991 in
regard to the above referenced project. This letter is to
clarify the conditions and concerns that were discussed at
the Planning and Zoning Board meeting on December 16, 1991
and which were contained in your letter. Please consider
the following clarifications or revisions along with final
approval of the Taco Bell Restaurant P.U.D. on January 27,
1992:
1. Hours of Operation -
This condition requires clarification prior to the
final hearing. The condition of "a midnight
closing of the dining room on Friday and Saturday,
and a midnight closing of the entire restaurant on
Sunday" fails to address Friday and Saturday night
drive-thru hours as well as Monday thru Thursday
night dining room and drive-thru hours. In
response to this issue, Taco Caliente would like
to propose the following complete operating
schedule for your review and approval. This

2. Intersection Improvements -
The intent of the river rock strip along Prospect
Road is to provide a temporary surface treatment
for the Summer 1992 growing season only, as the

Choices 195 intersection improvements are
currently scheduled for Spring 1993. If, prior to
the installation of this non -living ground cover,
it becomes evident that the intersection
improvements will be delayed for two or more
growing seasons (i.e. - postponed beyond August of
1993), Taco Caliente agrees to install irrigated
turf (bluegrass sod) in lieu of the temporary
river rock.
A note to this effect shall be placed on the site
plan and landscape plan prior to consideration for
Final P.U.D. approval.
3. Window Signage-
Per your request, at the time of Final P.U.D., the
site nlan ani elevations shall bear a rote
indicating that no temporary window signage will
be allowed. The etched glass window on the west
elevation is not affected by this restriction.
In conjunction with this restriction, the owner
feels that the inclusion of a reader board on the
corner monument sign would offer an acceptable
alternative to painted window signage, for the
advertisement of daily or weekly special
promotions. Attached please find a graphic detail
of the proposed revision to the corner monument
sign, which will be included for approval with the
Final P.U.D.
The following comments or revisions are offered in response
to the three design suggestions contained in your letter of
December 18, 1991:
1. Fence Height -
The arched wooden fence along the alley shall be
revised to be 5'-4" (min) to 6'-0" (max) in height
(in lien to 4'-8" to 5'-4" as proposed in
Preliminary P.U.D.). This entire fence structure

The drive-thru menu board shall be placed such
that the uppermost point of the menu board is no
higher than the uppermost point of the fence along
the east property line and alley.
2. West Monument Sign -
The small monument sign in front of the west
elevation of the building will be an internally
illuminated single -faced sign cabinet placed
parallel to College Avenue as indicated on the
site plan. The sign shall be a standard Taco Bell
sign cabinet with the "Taco Bell Oxblood"
background color. However, at the time of Final
P.U.D. approval, the sign base will be shown to be
constructed of brick units to match the existing
house, as opposed to a stucco sign base as shown
on the Preliminary P.U.D. submittal.
3. Parking Lot "Closure" -
As discussed at the preliminary hearing, we feel
that it would represent a safety hazard to propose
any type of barricade to prevent egress to or from
the parking lot when only the drive-thru lane is
open. In addition, we feel that the right turn
only movement required when exiting the drive-thru
will highly discourage a "return trip" to the
parking lot.
However, to provide a discouraging factor and a
tool for enf'%r^_erent ?F. Srn1 11 =11n . t the
placement of portable "signs at the parking lot
entrances reading "DRIVE-THRU OPEN/DINING ROOM AND
PARKING LOT CLOSED". These signs could be easily
placed and removed by restaurant employees at the
appropriate times. They should, however, be of
sufficient size and weight to discourage theft or
vandalism.
