Dear Ted,
This letter is to request that the above referenced item be

Planning and Zoning Commission hearing. As we discussed on
the telephone, this request for withdrawal is being made for
the following reasons:
1. The revisions requested in your December 18, 1990
letter of review for the construction of a new
restaurant facility (Taco Bell Standard Plan) are
unacceptable to the Owner.
2. A period of additional time will be required for
the local franchisee to receive written approval
and authorization from Taco Bell Corporation to
further pursue remodeling and adaptive reuse of
the Wickersham residence at 1530 South College
Avenue for use as a Taco Bell Restaurant.
While the above statements summarize our reasons for
withdrawal at this time, the Owner is also extremely
concerned with the city's position regarding the land
required for the proposed right-of-way improvements. The
Owner feels as though the City of Fort Collins should
acquire the required property by purchasing it at fair
market value or offer an equal sum of money as credit
against development fees for both the College/Prospect and
College/Boardwalk Taco Bell sites.
When we spoke on the telephone, I suggested that you set up
a meeting with the proper city staff people to discuss this
topic with the Owner. I think this would be an excellent
idea because this is a critical issue which could determine
whether or not the owner proceeds with any new development
plans at the Prospect site. Please let me know when you are
able to arrange a meeting time.
