91- 26 Stating the Intent of the City to Annex Certain Property and
Annexation Proceedings for Such Property to be Known as the USDA
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The property being considered for annexation has, for a period of not less than
three (3) years, been completely surrounded by property contained within the
boundaries of the City of Fort Collins. The property being considered for
annexation is approximately 1.07 acres in size and is located on the east side
of Timberline Road, between Drake and Horsetooth Roads. The property is
currently used for agricultural research. There are several large warehouse
structures on the property.
The proposed Resolution determines that it is in the best interest of the
citizens of the City to annex the area and that the annexation complies with the
Municipal Annexation Act. The Resolution also determines that a hearing should
be established regarding the annexation, and directs that notice be given of the
hearing. The hearing will be held at the time of first reading of the annexation
and zoning ordinances on April 16.
The property is located within the Fort Collins Urban Growth Area. According
to policies and agreements between the City of Fort Collins and Larimer County
contained in the Interqovernmental Agreement for the Fort Collins Urban Growth
Area, the City will consider the annexation of property in the UGA when the
property is eligible for annexation according to state law. The property became
completely surrounded by the City of Fort Collins through the following
annexations:
N: Blue Spruce Farms Annexation, October 6, 1987
E: Blue Spruce Farms Annexation, October 6, 1987
S: Blue Spruce Farms Annexation, October 6, 1987
W: Greenwalt 10th Annexation, June 21, 1977.
The property is owned by the United States Department of Agriculture.
The Colorado Annexation Act provides that property which has been entirely
contained within the boundaries of a municipality for a period of at least three
years may be annexed by the City Council, by ordinance, without consideration
of eligibility requirements and limitations as are otherwise applied to

annexations under the Act, and without hearing, provided that notice is given
of the annexation.
Planning and Zoning Board Recommendation:
The Planning and Zoning Board will conduct a public hearing on the annexation
and zoning request at its regular monthly meeting on February 25, 1991, and will
make its recommendation at that time. The Board's recommendation will be
forwarded to the City Council in time for the public hearing and first readings
of the annexation and zoning ordinances on April 16.
RESOLUTION 91-26
OF THE COUNCIL OF THE CITY OF FORT COLLINS
STATING THE INTENT OF THE CITY OF FORT COLLINS
TO ANNEX CERTAIN PROPERTY AND
INITIATING ANNEXATION PROCEEDINGS FOR SUCH PROPERTY
TO BE KNOWN AS THE USDA ANNEXATION
WHEREAS, the property hereinafter described has, for a period of not less
than three (3) years prior to this date, been completely contained within the
boundaries of the City of Fort Collins; and
WHEREAS, the Council of the City of Fort Collins has determined that it is
in the best interests of the citizens of the City to annex said area into the
City, as contemplated in the Intergovernmental Agreement between the City and
Larimer County, Colorado, dated September 7, 1988; and
WHEREAS, the Council desires to initiate annexation proceedings in
accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That, the Council of the City of Fort Collins intends to annex
the following described property, to be known as the USDA Annexation, situate
in the County of Larimer, State of Colorado, to wit:
A tract of land situate in the Northwest Quarter of Section 29,
Township 7 North, Range 68 West of the 6th P.M., Larimer County,
Colorado, which considering the West line of Northwest Quarter of
said Section 29 as bearing S 00°04'08" E and with all bearings
contained herein relative thereto, is contained within the boundary
lines which begin at the Northwest corner of said Section 29 and run
thence S 00°04'08" E 2159.50 feet, and again N 89°55'52" E 30.00
feet to the true point of beginning; thence N 89°55'52" E 231.50
feet; thence S 00°04'08" E 150.00 feet; thence S 89°55'52" W 109.35
feet; thence S 00'04'08" E 96.00 feet; thence S 89°55'52" W 122.15
feet; thence N 00°04'08" W 246.00 feet to the point of beginning.
Containing 1.0664 acres.
Section 2. That the Council hereby initiates annexation proceedings for
the above described property.
Section 3. That the Notice attached hereto be adopted as a part of this
Resolution. Said Notice establishes the date, time and place when a hearing
will be held regarding the passage of an annexation ordinance pertaining to the
above described property. The City Clerk is directed to publish a copy of this
Resolution and said Notice as provided in Section 31-12-108(2), C.R.S.

Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 19th day of February, A.D. 1991.

TO ALL PERSONS INTERESTED:
PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has
adopted a Resolution initiating annexation proceedings for the USDA Annexation,
said Annexation being more particularly described in said Resolution, a copy of
which precedes this Notice.
That, on April 16, 1991, at the hour of 6:30 p.m., or as soon thereafter
as the matter may come on for hearing in the Council Chambers in the City Hall,
300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins City Council will
hold a public hearing upon the annexation petition for the purpose of finding
and determining whether the property proposed to be annexed meets the applicable
requirements of Colorado law and is considered eligible for annexation. At such
hearing, any persons may appear and present such evidence as they may desire.
