Dear Property Owner,
In May of 1980, the governments of Larimer County and the City of
Fort Collins, Colorado, officially adopted a land use planning
document known as THE INTERGOVERNMENTAL AGREEMENT FOR THE FORT
COLLINS URBAN GROWTH AREA. The purpose of the urban growth area
was to delineate an area surrounding Fort Collins which was deemed
appropriate for the development of urban types of land uses and
residential densities and the provision of urban levels of public
services and facilities. One of the stated intents of the urban
growth area agreement was to have urban development occur within
the City so that the provision of urban level services by the
County would be minimized.
One of the key implementation agreements reached between the County
and the City deals with the annexation of property within the urban
growth area. Essentially, the City has agreed to consider for
annexation, all property within the urban growth area that meets
State eligibility requirements for annexation. This annexation
agreement extends to both voluntary annexations and the involuntary
annexation of county enclaves. County enclaves are areas which
have been completely surrounded by the City. The State of
Colorado's annexation laws allow a municipality to annex county
enclaves which have been completely surrounded for three or more
years.
Property which you own, located south of East Lincoln Avenue,
northeast of Riverside Avenue, and west of the Link-N-Greens and
Waste Water Treatment Plant No. 1 properties, as well as the
Burlington Northern Railroad Right of Way from Prospect Road to
just north of the Waste Water Treatment Plant, is included within
such a county enclave. (Please see attached map for specific
location of this annexation request). City staff has prepared an
Annexation Request as the first step in the process of annexing
your property. The annexations will be called: The East Lincoln
Avenue Second Annexation and Zoning and the Burlington Northern
Southeast First Annexation and Zoning.
City Staff has also proposed that your property, with the exception
of the Burlington Northern Railroad property, be placed in the R-C,
River Corridor, Zoning District. R-C zone is for areas developing
within the Downtown River Corridor of the Cache La Poudre River.
The following uses are allowed within the R-C zone:

1. Single-family dwellings;
2. Two-family dwellings;
3. Public and private schools for elementary and high school
education;
4. Colleges and universities;
5. Multifamily dwellings;
6. Boarding and rooming houses;
7. Automobile repair, conducted inside of a building;
8. Banks, savings and loan and financial companies;
9. Churches;
10. Heliports;
11. Hotels and motels;
12. Indoor theaters (except adult entertainment);
13. Membership clubs;
14. Offices and clinics;
15. Parking lots and parking garages;
16. Parks and playgrounds;
17. Personal service shops;
18. Printing and newspaper offices;
19. Recreational uses;
20. Standard restaurants; bars;
21. Retail stores;
22. Public utility installations;
23. Laundry and dry-cleaning outlets whose business consists
primarily of serving retail customers;
24. Public and private vocational and technical schools;
25. Fraternity and sorority houses;
26. Full -line pet shops not containing facilities for boarding
animals;
27. Small animal veterinary clinics;
28. Group homes;
29. Light industrial uses (subject to the performance standards
included in sec. 29-415 of the Zoning Code). Light industry
shall not include uses such as mining and extracting
industries, petrochemical industries, rubber refining, or
primary metal and related industries.
30. Accessory buildings and uses.
31. Any use located on a Planned Unit Development plan as defined,
processed, and approved according to sec. 29-526 of the Zoning
Code.
32. Any use which is currently an active, legal use under the
existing zoning.
The Planning staff is proposing that the Railroad property be
placed in the T, Transitional, Zoning District. The T zone. is for
properties which are in a transitional stage with regard to
ultimate development. In other parts of the City, the Planning
staff has placed railroad rights -of -way in the Transitional zone as
a holding zone until the future uses of these right-of-ways are
more defined. No use is permitted in the T District, except for
uses such as existed on the date the property was placed in this
zoning district. Prior to any new development on properties in the
T district, the property must be removed from the T zone and placed
in another zoning district.
The Annexation Request will be reviewed by the Fort Collins
Planning and Zoning Board on May 20, 1991, at the Board's regular
monthly meeting scheduled to start at 6:30 p.m. in the Council
Chambers in City Hall West, located at 300 Laporte Avenue. The
Board will conduct a public hearing and make a recommendation on
the Annexation request to the Fort Collins City Council. The City
Council will consider official annexation and zoning of the
property via public hearing and first reading of the annexation
ordinance on July 9, 1991.
County residents typically have many questions regarding the
annexation of their property. Enclosed is additional information
regarding annexations, titled ANNEXATION INFORMATION, which
discusses Colorado's Annexation Statutes, taxes, and services and
facilities.
