RECOMMENDATION: Approval EXECUTIVE SUMMARY: This is a Development Services staff -initiated request to amend certain sections of Chapter 29- 526 of the Code, relating to the LAND DEVELOPMENT GUIDANCE SYSTEM. During the Performance Audit of the LDGS that took place in 1990, it became apparent that many people were unable to distinguish between a master plan for a singular development, often subject to frequent changes, and a "comprehensive" (city-wide) master plan, such as the Parks and Recreation Master Plan. Staff is recommending that the name "Master Plan", when referring to a privately -owned property, be changed to "Overall Development Plan" throughout the LDGS. Boa 580 Fort Collins. 00 80522-0580 (303) 221-6750 PLANNING DEPARTMENT Amendments to Chapter 29 of the Code, Relating to the LDGS February 25, 1991 P & Z Meeting Page 2 COMMENTS: City Council provided for Master Planning of Phased Developments with City Ordinance No. 172, 1979, approved on January 8, 1980. The original ordinance amended the PUD regulations to allow for review of Master PUD plans and phasing of Preliminary PUD plans. A Master Plan submittal and review became an integral element of the LAND DEVELOPMENT GUIDANCE SYSTEM for Planned Unit Developments with its adoption in 1981. During the Performance Audit of the LDGS that was completed in October, 1990, a small but important issue arose as a result of input received from the private sector. In discussing master plan changes it became apparent that many people consider the name "Master Plan" to mean the equivalent of "City comprehensive plan" (i.e. Master Street Plan, Parks and Recreation Master Plan, etc.). The name should be changed to something that reflects its status as a privately proposed and publicly approved overall development plan for a parcel of private land. The name "Overall Development Plan" is recommended by staff. Presently, a master plan for the entire development site, together with the proposed preliminary plans for the first phase of development, is required if a property under one ownership is intended to be developed over time in two or more separate preliminary plan submittals. These amendments are "housekeeping" type changes and will replace the name "Master Plan" with "Overall Development Plan" throughout the LAND DEVELOPMENT GUIDANCE SYSTEM (where applicable). References to master plans in the LDGS that will not be changed, because of the context in which they are used, are as follows: Master Street Plan in the All Development criteria and APPENDIX B. 2. Fire Protection and Emergency Services Master Plan in APPENDIX B. 3. Master Plan as defined in Section 2.5.2 (5.1) of the Poudre River Trust Land Use Policy Plan and referred to in the Downtown River Corridor criteria of the LDGS. RECOMMENDATION: Approval of Amendments to Chapter 29-526 of the Code, relating to the LAND DEVELOPMENT GUIDANCE SYSTEM for Planned Unit Developments, changing the name from "Master Plan" to "Overall Development Plan" where relevant throughout the LDGS. Staff recommends that the Planning and Zoning Board recommend approval for the name change to City Council.
