PROJECT DESCRIPTION:
Request to annex and zone approximately 1.41 acres located at the southwest
corner of East Mulberry Street (Colorado Highway 14) and Lemay Avenue. The
requested zoning is RC, River Corridor. This is a voluntary annexation of City
owned property.
RECOMMENDATION:
Staff recommends approval of the annexation and zoning request.
EXECUTIVE SUMMARY:
This is a request to annex and zone approximately 1.41 acres of City owned
property located at the southwest corner of East Mulberry Street and Lemay
Avenue. The property was donated to the City of Fort Collins by Mr. Jack
Williams. The requested zoning is RC, River Corridor District. This is a
voluntary annexation. The property lies within the floodway of the Poudre River
and is currently vacant. Mr. Williams will retain an easement for the next
fifteen years for the existing off -premise sign. The City intends to use the
property as a part of the Poudre River trail system for trail head parking and
open space.

Background:
The property is located within the Fort Collins Urban Growth Area. According to
policies and agreements between the City of Fort Collins and Larimer County
contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH
AREA, the City will agree to consider for annexation, property in the UGA when
the property is eligible for annexation according to State law.
The area to be annexed meets the minimum 1/6 contiguity to existing city limits
requirement, through the following annexations (in parentheses are the associated
land uses):
N: Highway 14 East Third Annexation (Highway 14 right-of-way and vacant)
E: Lemay Avenue First Annexation (Lemay Avenue right-of-way and vacant)
S: Riverside Lemay Annexation (Poudre River and vacant)
W: Riverside Lemay Annexation (Poudre River and vacant)
The property is owned by the City of Fort Collins and is entirely within the
Poudre River floodway. The City intends to use the property as open space for
the River Corridor and for a future parking area for the Poudre River trail
system.
This annexation is a 100% voluntary annexation. According to the Municipal
Annexation Act, when the municipality is the sole owner of the area that it
desires to annex and if the requested annexation meets the eligibility
requirements, the governing body may by ordinance annex the area without notice
and hearing. Therefore no public hearing will be held by City Council for the
annexation ordinance. A public hearing for the zoning ordinance will be
conducted at first reading of the annexation and zoning ordinances scheduled for
the April 16, 1991 City Council meeting.
There is an existing commercial off -premise sign on the property. As a condition
of the land donation, Mr. Williams will retain an easement for the existing sign
until December 31, 2005. All existing commercial signs on the property will have
to conform to the City Sign Code following a five year amortization period. The
annexation includes no public rights -of -way.

The property is currently zoned ` -4—r—Farming, in the County. The requested
zoning for this annexation is the RC, River Corridor, Zoning District. The
River Corridor designation is for properties which are developing within the
Downtown River Corridor of the Cache La Poudre River. The RC, River Corridor,
District designation is consistent with the zoning of surrounding properties.

Findings:
1. The annexation of this property is consistent with the policies and
agreements between Larimer County and the City of Fort Collins as
contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN
GROWTH AREA.
2. The area meets all criteria included in State law to qualify for
annexation by the City of Fort Collins.
3. Ordinances annexing and zoning the property will be considered for first
reading by the City Council on April 16, 1991. Public hearing for the
zoning ordinance will be held on April 16, 1991.
4. The requested zoning of RC, River Corridor, is in conformance with the
policies of the City's Comprehensive Plan and the Poudre River Trust Land
Use Policy Plan, adopted in 1986 as an element of the Comprehensive Plan
of the City of Fort Collins and is consistent with the zoning of adjacent
properties.
RECOMMENDATION:
Staff recommends approval of the annexation and requested zoning.
