Resolution 91-XX Stating Intent to Annex Certain Property and Initiating Annexation
Proceedings for Such Property to be Known as the Springer Annexation.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The property being considered for annexation is owned by the City of Fort Collins and is
located at the northwest corner of Lemay Avenue and East Mulberry Street (Colorado Highway
14). The property was donated to the City of Fort Collins in late 1990 by the Fischer -Springer
Trust and consists of approximately 4.802 acres. The property consists of the Poudre River and
associated floodway. The City intends to use the property for open space for the River
Corridor and trail system. The area on the bluff west of the River may be used as a
maintenance area for the trail system.
The proposed Resolution determines that it is in the best interest of the citizens of the City to
annex the area and that the annexation complies with the Municipal Annexation Act.
According to the Municipal Annexation Act, when the municipality is the sole owner of the
area that it desires to annex and if the requested annexation meets the eligibility requirements,
the governing body may by ordinance annex the area without notice and hearing. The first
reading of the annexation and zoning ordinances is scheduled for May 7, 1991.
BACKGROUND:
The property is located within the Fort Collins Urban Growth Area. According to policies and.
agreements between the City of Fort Collins and Larimer County contained in the
Intergovernmental Agreement for the Fort Collins Urban Growth Area, the City will agree to
consider annexation of property in the UGA when the property is eligible for annexation
according to state law. The property is meets the 1/6 contiguity to existing city limits
requirement, through the following annexations: (in parenthesis are the associated land uses)
N: Link-N-Greens Annexation (Golf Course, trail, and open space)
E: unincorporated Larimer County (vacant)
S: Highway 14 East Second Annexation and Riverside-Lemay Annexation (vacant
and State Highway right-of-way)
W: Wastewater Treatment Plant No. I Annexation (City wastewater treatment
plant).
The property is owned by the City of Fort Collins. This annexation request is a 100% voluntary
annexation. According to the Municipal Annexation Act, when the municipality is the sole
owner of the area that it desires to annex and if the requested annexation meets the eligibility
requirements, the governing body may by ordinance annex the area without notice and hearing.
The first reading of the annexation and zoning ordinances is scheduled for May 7, 1991.
Planning and Zoning Board Recommendation:
The Planning and Zoning Board will conduct a public hearing on the annexation and zoning
request at their regular monthly meeting on March 25, 1991, and will make their
recommendation at that time. The Board's recommendation will be forwarded to the City
Council in time for public hearing and first readings of the annexation and zoning ordinances.
