PROJECT DESCRIPTION:
Request to annex and zone approximately 4.802 acres located north
of East Mulberry Street (Colorado Highway 14) and west of Lemay
Avenue. The requested zoning is RC, River Corridor. This is a
voluntary annexation of City owned property.
RECOMMENDATION:
Staff recommends approval of the annexation and zoning request.
EXECUTIVE SUMMARY:
This is a request to annex and zone approximately 4.802 acres
located north of East Mulberry Street and west of Lemay Avenue.
The property was donated to the City of Fort Collins in late 1990
by the Fisher -Springer Trust. The requested zoning is the RC,
River Corridor, District. This is a voluntary annexation of City
owned property. The property consists of a section of the Poudre
River and its associated bluff and floodway areas. The City
intends to use the property as open space for the River Corridor
and trail system. The area on the bluff to the west of the River
may eventually be used as a maintenance area for the trail system.
All existing commercial signs located on the property will have to
conform to the City's Sign Code at the conclusion of a five year
amortization period.

Background:
The property is located within the Fort Collins Urban Growth Area.
According to policies and agreements between the City of Fort
Collins and Larimer County contained in the INTERGOVERNMENTAL
AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, the City will
agree to consider for annexation, property in the UGA when the
property is eligible for annexation according to State law.
The area to be annexed meets the minimum 1/6 contiguity to existing
city limits requirement, through the following annexations (in
parentheses are the associated land uses):
N: Link-N-Greens Annexation (golf course, trail, and open
space)
E: unincorporated Larimer County (vacant)
S: Highway 14 East Second Annexation and Riverside-Lemay
Annexation (Poudre River, vacant, and State Highway right-
of-way)
W: Wastewater Treatment Plant No. 1 Annexation (City
wastewater treatment plant)
The property is owned by the City of Fort Collins and consists of
a section of the Poudre River and its associated bluff and
floodway. The City intends to use the property as open space for
the River Corridor and trail system. The area on the bluff west of
the River may eventually be used as a maintenance area for the
trail system.
This annexation is a 100% voluntary annexation. According to the
Municipal Annexation Act, when the municipality is the sole owner
of the area that it desires to annex and if the requested
annexation meets the eligibility requirements, the governing body
may by ordinance annex the area without notice and hearing.
Therefore no public hearing will be held by City Council for the
annexation. A public hearing for the zoning ordinance will be
conducted at the time of first reading of the annexation and zoning
ordinances scheduled for the April 16, 1991 City Council meeting.
Existing commercial signs on the property will have to conform to
the City's Sign Code at the conclusion of a five year amortization
period. This annexation includes no public rights -of -way.

The property is currently zoned , , in the County. The
requested zoning for this annexation is the RC, River Corridor,
Zoning District. The River Corridor designation is for properties

which are developing within the Downtown River Corridor of the
Cache La Poudre River. The RC, River Corridor, District
designation is consistent with the zoning of adjacent properties.
Findings:
1. The annexation of this property is consistent with the
policies and agreements between Larimer County and the City of
Fort Collins as contained in the INTERGOVERNMENTAL AGREEMENT
FOR THE FORT COLLINS URBAN GROWTH AREA.
2. The area meets all criteria included in State law to qualify
for annexation by the City of Fort Collins.
3. Ordinances annexing and zoning the property will be considered
for first reading by the City Council on April 16, 1991. A
public hearing for the zoning ordinance will be conducted at
the April 16, 1991 City Council meeting.
4. The requested zoning of RC, River Corridor, is in conformance
with the policies of the City's Comprehensive Plan and the
Poudre River Trust Land Use Policy Plan, adopted in 1986 as an
element of the Comprehensive Plan of the City of Fort Collins,
and is consistent with the zoning of adjacent properties.
RECOMMENDATION:
Staff recommends approval of the annexation and requested zoning.
