SUBJECT:
Hearing and First Reading of Ordinance No. 56 , Vacating a Utility Easement
Located Along the Side Lot Line of 1205 Parkwood Drive.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
EXECUTIVE SUMMARY:
Light and Power changed the location of the oval electrical vault, thereby
negating the need for the existing easement.
All City departments and private utility companies have been informed of the
location and the proposed vacation of the utility easement change and have no
objections.
A new replacement easement agreement located along the front of the lot line of
1205 Parkwood Drive (See attached sketch) is on the current Council agenda for
approval under Routine Deeds and Easements.
ORDINANCE NO. 56 , 1991
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A UTILITY EASEMENT LOCATED ALONG
THE SIDE LOT LINE OF 1205 PARKWOOD DRIVE
WHEREAS, the Council of the City of Fort Collins has been petitioned to
vacate a utility easement located along the side lot line of 1205 Parkwood Drive
set forth in particular below; and
WHEREAS, the City's Light and Power Department has changed the location
of an oval electrical vault, thereby removing the need for the utility easement;
and
WHEREAS, all City departments and private utility companies impacted by
the change have been informed of the location change and the proposed vacation
of the utility easement and have no objections thereto; and
WHEREAS, a utility easement to replace the utility easement to be vacated
hereunder is on the current Council agenda for Approval under Routine Deeds and
Easements (and is located along the front line of 1205 Parkwood Drive); and
WHEREAS, the rights of the residents of the City of Fort Collins will in
no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the utility easement located along the side lot line of 1205 Parkwood Drive,
set out more particularly as follows, to wit:
The utility easement along the side lot line of Lot 2, Parkwood
First Filing (1205 Parkwood Drive), City of Fort Collins, County of
Larimer, State of Colorado, recorded in -the records of the Larimer
County Clerk and Recorder on September 10, 1990, at Reception Number
90041215;
be and the same hereby is vacated, abated and abolished.
Introduced, considered favorably on first reading, and ordered published
this 21st day of May, A.D. 1991, and to be presented for final passage on the
4th day of June, A.D. 1991.
