The rear lot fences for the three properties affected by the easement (3431, 3437, and 3443 Sun Disk Court) have been constructed on the property lines approximately 4' back from the sidewalk. A recent agreement between the City and the developer, John Giuliano of Giuliano & Father Construction, Inc., allows: * The fences to remain in their present locations, * the 6 trees as shown on the recorded Overall Utility Plan to be planted inside the fences on the individual lots, and * a cobblestone groundcover to be placed in the 4' wide space between the back of sidewalk and the fences. This strip is in the public street right-of-way. Mr. Giuliano has satisfactorily implemented the tree plantings (being 6 Linden trees in the backyards) and laying of the cobblestone in the street right-of-way.
