Request for Vacation of Frontage Road Right -of -Way
Dear Kerrie,
In association with the proposed Chili's Grill and Bar project, Shear
Engineering is formally requesting that Right -of -Way vacation procedures
be started for the vacation of a portion of the Frontage Road Right -of -Way
on the west side of South College Avenue adjacent to the proposed Chili's
site. The exhibit and legal description of that portion of the Frontage
Road Right -of -Way being vacated is attached as required by the City of
Fort Collins Vacation of Right -of -Way procedures. The vacation exhibit and
legal description was prepared by Frederick Land Surveying.
Our request for this Right -of -Way vacation is with the understanding that
the City of Fort Collins is also interested in the vacation proposed due
to safety issues associated with the intersection of the Frontage Road
with Foothills Drive. The vacation would create additional parking area
for the Chili's project. Several new secondary access scenarios are
available to Dellenbach Chevrolet's business. One of these scenarios is
represented on our submittal drawings for the Chili's project.
The limits of the vacation would be from a line being the extention of the
Foothills Drive north Right -of -Way line, north to a line being an
extention of Dellenbach's south property line (Northerly line of Mourning
Subdivision). The westernmost forty feet (40') of the existing fifty foot
(50') .Frontage Road Right -of -Way will be vacated (see Right -of -Way
vacation exhibit attached). This will maintain the City of Fort Collins
requirements for major arterials. Sixty feet of 1/2 Right -of -Way from the
centerline will be maintained. The westernmost Right -of -Way line will be
16' west of the westernmost South College Avenue curb and gutter flowline.
- We understand that the Right -of -Way vacation requires two (2)--readings of
City Council and that the two (2) readings will happen after project final
plat approval by the Planning and Zoning Board which is expected to be
January 27, 1992. This would allow the vacation of the Right -of -Way to be
completed by the first week in March of 1992. The plat can be filed
immediately after filing of vacation documents.
