Subject: Fort Collins Post Office Intergovernmental Agreement
Dear Ted:
The Intergovernmental Agreement, prepared by the City of Fort Collins, is not acceptable as written.
The USPS has directed Merrick & Company to prepare a draft of the Intergovernmental Agreement
based upon our (and the Postal Service's understanding) of the negotiations and meetings to date.
On behalf of the Postal Service, I have enclosed a draft of the Intergovernmental Agreement that the
Postal Service has reviewed for content. The basic premise in developing this Agreement is (and
should have been) that there never was a commitment on either the City or the USPS to commit to
future changes. The recommendations from the future traffic study would be considered and
modifications made if mutually agreed to. The attached Intergovernmental Agreement reflects the
Postal Service's impression of what was said, and agreed to, in all the previous meetings.

INTERGOVERNMENTAL AGREEMENT
THIS AGREEMENT is executed this day of , 1992, by and
between THE CITY OF FORT COLLINS, COLORADO, a municipal corporation ("the City")
and the UNITED STATES POSTAL SERVICE ("Postal Service").
WITNESSETH:
WHEREAS, the Postal Service intends to construct a new post office building ("Post
Office") on property located in the City of Fort Collins, Larimer County, Colorado, and more
particularly described as follows, to wit:
WHEREAS, the Postal Service intends to provide vehicular access to the Post Office,
whereby Post Office customer traffic ingress will be provided by a driveway located at the
intersection of Boardwalk Drive and Landings Drive, and Post Office customer traffic egress
will be provided by a driveway located on JFK Parkway, approximately 333 feet south of
Boardwalk Drive; and
WHEREAS, the City believes that the proposed Post Office customer traffic ingress and
egress for the Post Office will result in traffic congestion, safety problems and excessive traffic
burdens upon the adjacent streets, specifically, Boardwalk Drive and/or Landings Drive: and
WHEREAS, the Postal Service believes that the Post Office customer ingress and egress
will not result in the traffic problems identified by the City; and
NOW, THEREFORE, in consideration of the mutual promises of the parties, the parties
agree as follows:
1. At such time that JFK Parkway is completed between Boardwalk Drive and Horsetooth
Road, and a traffic signal is placed in operation at the intersection of JFK Parkway and
Boardwalk Drive, the City and the Postal Service shall review the impact of the Post Office
customer ingress and egress to determine if said Post Office customer ingress and egress has
resulted in a negative impact upon Boardwalk Drive and/or Landings Drive. If, upon review,
the Postal Service and the City agree that an undesirable traffic circulation, congestion or safety
problem exists in the area of the Post Office customer ingress and egress that may be attributed
to the ingress or egress locations, then the City and the Postal Service shall participate equally
in the employment of a completely independent and mutually agreed upon Professional Traffic
Engineer to conduct an analysis of traffic in the area of the Post Office to ascertain the causes
of the traffic circulation, congestion or safety problems mentioned above. This professional shall
prepare a written report outlining the problems, the causes, and recommend solutions to the
problems.
2. The Postal Service shall review the recommendations stated in the traffic study and take

the recommended solutions into consideration.
3. The City shall review the recommendations stated in the traffic study and take the
recommended solutions into consideration.
4. If any traffic impacts or problems identified by the traffic study are determined to be
attributable to a lack of adequate street capacity or other circumstances otherwise caused by
other than the Post Office, then the City shall consider, at it's expense, the changes necessary
to design and construct the solutions required to mitigate the problems as recommended by the
traffic study.
5. If any traffic impacts or problems identified by the traffic study are determined to be
caused by the location of the Post Office customer traffic ingress and egress, then the Postal
Service shall consider, at it's expense, the changes recommended by the traffic study.
6. If any traffic impacts or problems identified by the traffic study are determined to be
caused in part by the City and in part by the Post Office customer ingress and egress locations,
then both parties to this agreement shall consider cooperating in apportioning the costs of design
and construction of the recommended solutions necessary to mitigate the various traffic impacts
identified in the traffic study.
7. Changes agreed to be made shall be allowed a reasonable amount of time to have the
project budgeted and funds appropriated to design and construct the improvements recommended
to resolve the traffic problems.
8. The parties to this agreement recognize that this agreement contemplates a mutual
cooperation and a good faith effort on the part of both parties to consider and resolve the traffic
problems that may be shown to have arisen.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement the day and
year first written.
