Frontage Road Fort Collins, CO. 80525 Dear Jackson: City staff has reviewed your submittal for Excellart Subdivision, Non -Conforming Use request, and offers the following comments: 1. This property is in the HB, Highway Business zone, which does not allow the proposed "automobile related activities" as a Use -by -Right. The two options available to you to be able to operate as an auto -related use, as requested, are the Non - Conforming Use Review and the Planned Unit Development Review processes. The Non -Conforming Use Review is designed to allow a change from one existing use to one other use. The manner in which your land use intent is described under the PLANNING OBJECTIVES would not fit the criteria for the change in use. The statements "a change to allow an additional non -conforming use for automobile related activities" and "We will also maintain our present right to use the property for our sign business, in whole or in part" precludes the ability to review this request as a non -conforming use. The second option, the PUD Process, is the appropriate mechanism to create the "mixed -use" on this site and give you additional flexibility for future requests. This approach will provide you with the ability to operate both types of businesses on this site simultaneously; however, --a future change in use on this site would necessitate an amendment to the PUD. Minor physical changes to the site may be handled administratively under an approved PUD. 2. The conversion from the Non -Conforming Use Review, as requested, to the Preliminary and Final PUD request will be handled in the Development Review Center by your project planner, withyour permission. Your submittal is complete enough to qualify for continuation .in the process with the addition of the appropriate point charts from the Land Development Guidance System. Enclosed you will find copies of the Auto -Related Roadside Commercial, Point Chart D and Business Service Uses, Point Chart E. Both point charts achieve the minimum 50% of the maximum possible points. No additional submittal fees are to be required with this request. 281 North. College Avenue - P.O. Box 580 - Fort Collins, CO 80522-0580 - (303) 221-6750 3. A subdivision plat is not required since this property was subdivided as Excellart Subdivision in 1975. 4. All landscaping shown, both existing and proposed, must be maintained by the property owner. Please specify the mulches (gravel, woodchips, etc.) that you intend to use in the planting beds. 5. There are existing overhead power and telephone lines on -site. Easements should be shown for these utilities on the Site Plan. 6. Provide a handicapped parking space and access to and into the building. 7. The Site Plan for this request indicates customer parking in front of the building, requiring vehicles to back into North College Avenue. All access into the State highway must be in a forward motion. Definition into the property should be made with curb and gutter, and parking in front of the building must be'eliminated. 8. The access to the property at the north side of the building must be a defined 24' in width, to accommodate the proposed uses, allowing for two way traffic to and from the site. Explore the possibility of acquiring the needed width for an access easement across the property to the north. 9. The change in the use of the property will require that an Access Permit be applied for and obtained through the City as the."issuing authority". 10. Please change the name on the drawing .for this submittal to Site Plan for EXCELLART PUD. This concludes staff comments at this time. In order to stay on schedule for the May 20, 1991 Planning and Zoning Board hearing, --please note the following deadlines: -- Plan revisions are due May 1, 1991 by 12:00 noon PMT1s, colored renderings, revisions are due May 13,1991 Final documents are due May 16, 1991 by 12:00 noon I suggest we meet to discuss these comments at your earliest convenience.
