RE: Proposed Lease and Purchase Option Agreements
INTRODUCTION: On July 2, 1991 Council will consider the annexation
of the Bryan (Huber) property at 2711 South Taft Hill Road
(Huber Annexation). At the same time Council will be
considering two related items; (1) an ordinance leasing City
property to Mrs. Bryan; and (2) a resolution for the approval
of the purchase option of the Bryan property. We do not view
the transaction as controversial, however, this is not a
routine type of transaction that Council considers. Mrs.
Bryan would like to lease the recently purchased property
(Anton Property - Resolution 91-62) and is also agreeing to
sell her property to the City at a future date. (see map)
Staff would like to provide the following background
information in advance of the July 2nd packet.
BACKGROUND: The 1980 Spring Creek Master Plan identified the need
for a regional detention facility west of Taft Hill Road. The
second and current study, dated 1988, updated the previous
study and recommended that the regional detention facility be
immediately adjacent to South Taft Hill Road. Through a
preliminary design analysis staff verified this location to be
the most cost effective location.
It was originally anticipated that the acquisition of the site
necessary to construct the detention facility would be
initiated in 1996 or 1997. Also sometime after this date the
widening of South Taft Hill Road will take place. Since the
Anton's were willing sellers it was advantageous to acquire
their property. The purchase discussions with Anton's also
initiated discussions on purchase of the Bryan property since
they were neighbors and both properties were part of the

detention facility site identified by the master plan. During
the discussions Mrs. Bryan indicated a willingness to sell her
property at a future time which will coincide with the
projected future need of the Stormwater Utility (1996) and the
future widening of South Taft Hill Road. This area will also
provide a link with the Spring Creek Trail. As a condition of
the future purchase Mrs. Bryan requested to lease the Anton
property until the Bryan property is purchased.
The purchase option agreement shows the purchase price to be
$144,780 in 1996.
RECOMMENDATION: Staff recommends approval of the lease of the City
owned Anton property to the Bryan's and approval of the Option
Agreement for purchase of the Bryan property. Since the
residential structures on the site are located in the floodway
of Spring Creek, the Stormwater Utility is planning to include
the money necessary for the purchase of the Bryan property in
the 1996 capital improvements budget for Spring Creek.
The Bryan property (Huber Annexation) is also being considered
for annexation at the July 2nd meeting. Annexation into the
City was not a condition of either the lease agreement or the
purchase option agreement. This is a voluntary annexation.
